RECOMMENDATION(S)
Recommendation
1. Approve Cooperative Agreement between San Bernardino County and the City of Colton, effective on the date signed by both parties and through December 31, 2028, or project completion/final payment for the Road Improvements Project on Olive Street, whichever occurs first, wherein San Bernardino County will contribute $1,038,000 and the City of Colton will contribute $181,000 towards the $1,219,000 estimated total cost to install streetlights, sidewalk, Americans with Disabilities ramps and curb and gutter on Olive Street in the Colton Area.
2. Authorize the Director of the Department of Public Works to increase the San Bernardino County contribution amount, set forth in the Cooperative Agreement identified in Recommendation No. 1 for the Road Improvement Project on Olive Street, by up to 25 percent, from $1,038,000 to $1,297,500, should construction costs dictate such an increase.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Department of Public Works (Department) is funded by Gas Tax revenue, fee revenue and other federal, state, and local funding. The total cost to install streetlights, sidewalk, Americans with Disabilities (ADA) ramps, and curb and gutter on Olive Street between Jackson Street and Rancho Avenue in the Colton area (Project) is estimated to be $1,219,000. The County’s estimated share of cost of $1,038,000 is anticipated to be funded by the Community Development Block Grant (CDBG). The County anticipates final approval of the CDBG in July 2024. The remaining share of the Project's estimated cost of $181,000 will be funded by the City of Colton (City). Sufficient appropriation and revenue will be included in the Department’s 2024-25 Road Operations recommended budget (6650002000 H15201).
BACKGROUND INFORMATION
The City and San Bernardino County (County) share jurisdiction of a portion of Olive Street in the Colton area. The proposed Project consists of 1) installation of streetlights; 2) construction of sidewalk including curb and gutter; and 3) construction of ADA curb ramps on Olive Street, from 0.02 mile west of Jackson Street to 0.04 mile west of Rancho Avenue. The County has requested the City’s participation in the Project because approximately 0.08 mile of Olive Street, between Jackson Street and Rancho Avenue is within the City’s jurisdiction and will be impacted by the Project.
Approval of this item will allow the County to enter into a contract with the City, under which the County will serve as the lead agency for the Project. In accordance with the Cooperative Agreement, the City will provide a representative to discuss and/or resolve any issues that may arise during the construction of the Project. The Cooperative Agreement terminates upon completion of the Project and the County receives payment of final billing from the City, or on December 31, 2028, whichever occurs first. The City executed the Cooperative Agreement on April 2, 2024.
In accordance with the provisions of the Cooperative Agreement, the County will serve as the lead agency in the preliminary engineering, design, survey, California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) review and compliance, construction engineering, and inspection phases of the Project. Right-of-way activities are not anticipated for the Project and therefore are not included in the agreement.
To prevent delays in Project completion, this item also recommends that the Board of Supervisors authorize the Director of the Department, to increase the County’s contribution amount under the proposed Cooperative Agreement by up to 25 percent, from $1,038,000 to $1,297,500, should contractor bids exceed the original project estimate or construction costs necessitate such an increase.
The Project will ensure development of a well-planned, balanced, and sustainable County by preserving and improving the structural integrity of existing road surfaces on Olive Street in the Colton area. Furthermore, execution of the Cooperative Agreement and approval of the Project allows the County to meet its goals and objectives by working cooperatively with the City.
