Recommendation
1. Acting as the governing body for San Bernardino County, through its Land Use Services Department, approve Amendments No. 1 to assign the following contracts to San Bernardino County Fire Protection District, to provide fire hazard abatement services effective August 5, 2026, and extend the term of the contracts through June 30, 2031:
a. City of Yucaipa, Contract No. 10-804
b. City of Highland, Contract No. 10-805
c. City of San Bernardino, Contract No. 18-555
d. Arrowbear Park County Water District, Contract No. 10-599
2. Acting as the governing body for San Bernardino County Fire Protection District, approve Amendments No. 1 accepting the assignment of the following contracts from San Bernardino County, to provide fire hazard abatement services effective August 5, 2026, and extend the term of the contracts through June 30, 2031:

FINANCIAL IMPACT
Approval of the recommended actions will not result in the use of Discretionary General Funding (Net County Cost). The Fire Hazard Abatement (FHA) service agreements (collectively, Agreements) are revenue agreements for services provided to the contracting cities. Approval of this item will assign and replace the existing Agreements from San Bernardino County, through its Land Use Services Department (County), to the San Bernardino County Fire Protection District (SBCFPD). Beginning August 5, 2026, SBCFPD will assume administration, contract management, and service delivery responsibilities under the agreements and will receive the corresponding revenue under each agreement. Sufficient appropriation and revenue is included in the SBCFPD’s 2026-27 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
The County currently administers the FHA Agreements with various cities and districts. Through these Agreements, the County provides fire hazard abatement services which include identifying properties with hazardous vegetation or other fire hazards, coordinating enforcement and abatement activities, and supporting the recovery of applicable costs and fees. These services help reduce fire risk, promote public safety, and support compliance with applicable local and state requirements.
Approval of these actions transfers responsibility for the FHA Agreements from County to SBCFPD. Specifically, the recommended actions will approve an assignment and novation of the County’s rights, interests, duties, liabilities, and obligations under the existing Agreements to SBCFPD. Effective August 5, 2026, references to the County in the Agreements will be deemed to refer to SBCFPD, and SBCFPD will become responsible for administration, contract management, and service delivery under the Agreements. This transition aligns the program with the agency whose core mission includes fire prevention, fire hazard reduction, and public safety.
The amendments also document each contracting party’s consent to the assignment and replacement, update the notice address to SBCFPD, and extend the term of each Agreement through June 30, 2031, unless terminated earlier in accordance with the Agreements. Each Agreement will remain subject to its existing termination provision, which allows either party to terminate upon 60 days’ prior written notice.
Approval of the recommended actions will maintain continuity of FHA services for the contracting cities and Arrowbear Park County Water District while placing program responsibility with SBCFPD, whose core mission includes fire prevention, fire hazard reduction, and public safety. The transition is administrative in nature and is not anticipated to disrupt existing service levels. This alignment is also part of a broader County effort to place services within the departments or agencies best suited to administer them, improve operational efficiency, enhance program coordination, and support future program improvements.
