RECOMMENDATION(S)

Recommendation

1.                     Approve the purchase of license fees, media rights, equipment and supplies, and the use of funds for marketing events for World Cup viewing events, in the amount of $41,613.

2.                     Authorize the Director of the Regional Parks Department to make a payment in the amount of $14,000, for media rights for the World Cup viewing events, with non-standard terms in its regulations. 

3.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments to the Regional Parks Department 2025-26 budget, as detailed in the Financial Impact section (Four votes required).

FINANCIAL IMPACT

Approval of this item will result in the use of Discretionary General Funding (Net County Cost). The amount of $41,613 will allow the Regional Parks Department (Department) to obtain license fees, equipment, supplies, and marketing to be used for the Federation Internationale De Football Association (FIFA) World Cup 26 (Event) viewing events, which will be funded by a one-time allocation of General Fund Contingencies.

BACKGROUND INFORMATION

On May 19, 2026 (Item No. 33), the Board of Supervisors approved the purchase of a mobile LED screen from MUSCO Sports Lighting to be used for viewing events to enhance community engagement, improve event quality, and serve as a shared resource across multiple programs and initiatives. The screen can be utilized for a multitude of events, not just Department events.

 

The Department requested authorization from FIFA to show the Event and on June 1, 2026, FIFA contacted the Department authorizing the ability to view the Event upon payment for media rights in the amount of $14,000 and compliance with the FIFA Regulations.

 

The FIFA Media Rights Licensee Regulations for Public Viewing Events contain non-standard terms that differ from the standard County contract terms as follows:

 

1.                     Dispute Resolution: The parties will first endeavor to resolve any dispute by negotiation but if no negotiated solution is reached, disputes are exclusively resolved by arbitration administered under the Swiss Rules of International Arbitration of the Swiss Arbitration Centre. 

                     County standard Term: In the event of a dispute, the parties shall use their best efforts to settle the dispute through negotiation with each other in good faith.

                     Potential Impact: In the event of a dispute the County would have to participate in negotiations but if not resolved, the County would then have to participate in mandatory arbitration according to Swiss Rules. County Counsel cannot advise on whether and to what extent such arbitration provisions may be enforceable against a government entity under Swiss law. 

2.                     Governing Law/Venue: The Regulations state that the Regulations are governed by the laws of Switzerland and disputes in connection with the Regulations are to be exclusively resolved by an arbitral tribunal pursuant to the Swiss Rules of International Arbitration of the Swiss Arbitration Centre in Zurich.  

                     County standard Term: The County standard contract requires California governing law.

                     Potential Impact: The Regulations are governed by the laws of Switzerland. Because County Counsel is not able to advise on Swiss law, there is no specific analysis of possible legal impacts from the Regulations provisions.  The Regulations will be subject to the exclusive jurisdiction of the Swiss Arbitration Centre in Zurich to resolve any legal matter arising from the Regulations.    

3.                     Insurance: The Regulations mandates that the County maintain adequate general liability insurance in order to cover the proper performance and any damages in relation to the Public Viewing Event. 

                     County standard Term: The County policies require contractors to carry appropriate insurance at limits and under conditions determined by the County’s Risk Management Department and as set forth in County policy and in the County standard contract.

                     Potential Impact: The County has no assurance that the Licensor will be financially responsible for claims that may arise out of the Agreement, and the County has to maintain adequate general liability insurance. 

4.                     Termination: The County does not have the ability to terminate for convenience.

                     County standard Term: The County standard contract gives the County the right to terminate the contract, for any reason, with a 30-day written notice of termination without any obligation other than to pay amounts for services rendered and expenses reasonably incurred prior to the effective date of termination.

                     Potential Impact: The County may not terminate the Agreement for convenience but may terminate within 14 days if the Regulations are amended.

 

The viewing events are expected to enhance community engagement and ensure access to county residents. These viewing events are envisioned to promote inclusive programming while removing financial and logistical barriers to attendance. The viewing events would include food vendors, recreational activities, educational activities, and games.

 

PROCUREMENT

Purchasing supports the non-competitive purchase of a media rights license through FIFA based on the proprietary nature of the license.  FIFA is the exclusive owner and licenser of these media and public viewing rights and is the only entity authorized to grant permission for such use. The rights are proprietary in nature and cannot be obtained from alternative sources.
