RECOMMENDATION(S)

Recommendation

1.                     Accept and approve the Department of Health Care Services, California Providing Access and Transforming Health - Justice-Involved Planning and Capacity Building Program Grant Round 4, including the Acknowledgement of Grant Terms and Conditions and a non-standard term, in the amount of $300,000, for the performance period of January 30, 2023 through December 31, 2026.

2.                     Authorize the Chief Executive Officer or Chief Probation Officer to approve, electronically execute, and submit the Department of Health Care Services, California Providing Access and Transforming Health - Justice-Involved Planning and Capacity Building Program Grant, Round 4, Acknowledgment of Grant Terms and Conditions associated with the acceptance of grant funds, and administrative documents such as progress reports as required under the grants, subject to review by County Counsel.

3.                     Direct the Chief Probation Officer to transmit the Department of Health Care Services, California Providing Access and Transforming Health - Justice-Involved Planning and Capacity Building Program Grant Round 4 grant award documents, including the Acknowledgment of Grant Terms and Conditions, to the Clerk of the Board of Supervisors within 30 days of execution.

4.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post the budget adjustments to the 2025-2026 Budgets for the Probation Department, as detailed in the Financial Impact Section (Four votes required).

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Upon acceptance by the Board of Supervisors (Board), the Probation Department (Department) will receive a total grant award in the amount of $300,000, from the Department of Health Care Services (DHCS) for the California Providing Access and Transforming Health (PATH), Justice-Involved Planning and Capacity Building Program Grant (Grant), Round 4.

 

The Department requests the Auditor-Controller/Treasurer/Tax Collector post the following adjustments to the 2025-26 Department budget.

BACKGROUND INFORMATION

California State Assembly Bill 133 (Chapter 143, Status 2021) authorized PATH funding to support the planning processes related to the implementation of the full suite of statewide California Advancing and Innovating Medi-Cal (CalAIM) initiatives, such as the Justice-Involved Planning and Capacity Building Program that builds on the successful work conducted under Whole Person Care (WPC). The PATH Grant will expand access to pre-release and post-release Medi-Cal services under CalAIM.  

 

On October 25, 2022 (Item No. 86), the Board accepted the grant award for the PATH, Round 1 funding in the amount of $300,000, for protocols and information technology (IT) system infrastructure modifications necessary to implement or modify pre-release Medi-Cal enrollment and suspension of benefits. 

 

On August 22, 2023 (Item No. 44), the Board accepted the grant award for the PATH, Round 2 and Round 3 in the combined amount of $3,219,100. Round 2, in the amount of $719,100, were utilized to fund staffing, technology upgrades and modifications to physical infrastructure to assist with the completion of Medi-Cal applications at the County’s youth and juvenile detention facilities. Round 3, in the amount of $2,500,000, were dedicated to justice-involved pre-release services, behavioral health linkage implementation and Medi-Cal application and suspension process.

 

The PATH Grant Round 4 funding will be utilized to support the Department Operations division with expenses, including essential equipment, contracted services, and salary and benefit costs for staff time for the development of the billing reconciliation process.

 

The Grant includes an Acknowledgment of Grant Terms and Conditions (AGTC), that outlines the allowable use of funding and other responsibilities for the Department in using the grant funds. Additionally, the AGTC indicates that DHCS has designated a third-party administrator (TPA) to  communicate with the Department with respect to the Grant on their behalf.

 

The AGTC includes a term that differs from the County standard contract as follows:

 

1.                     The County agrees to release and hold harmless the TPA for any and all liability, actions, claims, demands, or suits, and related cost, attorney fees, and expenses arising out of, or relating to the receipt of the grant funds.  

                     The County standard contract does not include a limitation of liability.

                     Potential Impact: County will not be able to recover for potential claims against the TPA arising out of grant administration, leaving the County financially liable if a claim arises.

 

The Department recommends acceptance of the Grant and approval of the AGTC, including the non-standard term, as the benefits from the grant funding provided by DHCS outweigh the potential risks.

 

Acceptance of the AGTC in Recommendation No. 1 will allow the County to accept the grant funds. Recommendation No. 2 delegates authority to the CEO or the Chief Probation Officer to electronically execute the AGTC associated with acceptance of the grant, and to submit any electronically executed administrative documents, including subsequent progress reports required under the PATH Grant terms. The Grant Round 4 performance period appears to be retroactive to 2023, however, it is a continuation of previous Grant Round 2 and Round 3 funding and does not have a new start date.

 

The CalAIM initiative is a continuation of previously approved rounds. Should the State offer any additional CalAIM funding or related opportunities in the future, the Department will return to the Board with a separate item to request approval.
