RECOMMENDATION(S)
Recommendation
Acting as the governing body of the Bloomington Recreation and Park District:
1. Approve the use of $1,183,935 of American Rescue Plan Act funding for eligible costs associated with the Kessler Park Snack Bar and Restroom Renovation Project.
2. Authorize the Auditor-Controller/Treasurer/Tax Collector to post a budget increase of $1,183,935, as detailed in the Financial Impact section, for the Kessler Park Snack Bar and Restroom Renovation Project (Four votes required).
3. Approve Addendum No. 1, issued on April 3, 2023, to the bid documents for the Kessler Park Snack Bar and Restroom Renovation Project.
4. Award construction contract to Caltec Corp. in the amount of $1,640,290 for the Kessler Park Snack Bar and Restroom Renovation Project.
5. Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the construction contract with Caltec Corp. for the total not to exceed amount of $94,514.50, pursuant to Public Contract Code Section 20142.
6. Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). On September 21, 2021 (Item No. 53), the Board of Supervisors approved the use of $900,000 from the Bloomington Community Benefit/Improvement Reserve for the Kessler Park Snack Bar and Restroom Renovation Project in Bloomington (Project). These funds were transferred to the Bloomington Recreation and Park District (District) in 2022-23. With approval of Recommendation No. 1, the $900,000 will be augmented by $1,183,935 from the County’s American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery Fund (CLFRF) for eligible costs of the Project. This results in a total funding allocation of $2,083,935 for the Project, including the $1,640,290 cost of the recommended construction contract with Caltec Corp.

BACKGROUND INFORMATION
The Department of Public Works - Special Districts (Department), through its Operations Division, directly manages, operates and maintains the District, including Kessler Park. The existing 1,383 square foot snack bar and restroom building at Kessler Park was originally constructed in 1972. The interior spaces have been adapted for use by the Bloomington Little League, the current tenant, as enrollment and league participation has grown. The building’s electrical system needs improvement to support the load of snack bar equipment. The building also has no heating, ventilation, and air conditioning (HVAC) or air circulatory systems, and the existing snack bar equipment has deteriorated and needs replacement. The structural walls and foundation of the building are in good condition and will not require replacement. The Project consists of renovating the snack bar food service area, men’s and women’s restrooms and office area, and constructing a shade canopy on the west side of the building.
On March 28, 2023 (Item No. 56), the Board of Directors (Board) determined the Project was exempt under the California Environmental Quality Act and directed the Secretary of the Board to file and post said notice.
PROCUREMENT
On March 28, 2023 (Item No. 56), the Board approved the Project’s plans and specifications and authorized the Director of the Department to advertise the Project for bids. The Department advertised for bids through the County Electronic Procurement Network (ePro) website in accordance with Public Contract Code Section 22037. The following addendum was issued during the bidding phase:

On April 11, 2023, a total of seven contractors attended a mandatory pre-bid site meeting. On April 27, 2023, the bid from Caltec Corp. was received for $1,640,290.
The Department reviewed the bid received, determined the bid was responsive, and recommends an award of a construction contract to Caltec Corp. as the lowest responsible bidder. No appeal/protest letters were received.
Under an established formula based on the contract amount of $1,640,290, Public Contract Code section 20142 allows the Board to authorize the Director of the Department to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $94,514.50. Upon Board approval of this item, construction is anticipated to commence in July 2023 and be completed by February 2024.
