RECOMMENDATION(S)
Recommendation
1. Approve State of California Department of Housing and Community Development Power of Attorney form, including a non-standard term, appointing Legacy Modular Buildings, Inc. as the attorney-in-fact for the limited purpose of executing documents necessary to obtain California registration and titling of a modular office purchased by the Probation Department for pretrial release services in the West Valley Region.
2. Authorize the Chief Probation Officer or Assistant Chief Probation Officer to execute and submit the Power of Attorney form to the State of California Department of Housing and Community Development, subject to County Counsel review.
3. Direct the Chief Probation Officer or Assistant Chief Probation Officer to transmit a copy of the executed Power of Attorney form to the Clerk of Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Capital Improvement Program (CIP) Pretrial Release Services Modular Office Project No. 23-196 (Project), in the amount of $799,811, was funded with a one-time allocation from the Judicial Council of California for pretrial release services and included the purchase and installation of the modular office from Legacy Modular Buildings, Inc., as well as all costs associated with the registration and titling process. Approval of this item will not increase the Project budget or require additional appropriation.
BACKGROUND INFORMATION
On June13, 2023 (Item No. 53), the Board of Supervisors approved CIP Project No. 23-196, for the Pretrial Release Services Modular Office Project at the Probation training facility in the West Valley Region, to procure and install a portable modular office to accommodate Probation Department staff working on the Pretrial Release Services Program.
The portable modular office was purchased in June of 2025 and remains at the manufacturer’s facility pending completion of the necessary site preparation work and outbound transit. Prior to releasing the modular office for shipment, the manufacturer requires valid California registration and titling of the unit.
Approval of this item authorizes execution of the State of California Department of Housing and Community Development (HCD) Power of Attorney form, which appoints Legacy Modular Buildings, Inc. as the County’s attorney-in-fact for the limited purpose of signing documents necessary to obtain California registration and titling of a modular office purchased by the Probation Department. The modular office will be used to provide pretrial release services in the West Valley Region.
Under California law, certain manufactured and modular structures are required to be registered with HCD. As part of the registration process, HCD requires owners to execute a Power of Attorney authorizing the seller to prepare, sign, and submit registration documents on the owner’s behalf. Legacy Modular Buildings, Inc., as the seller of the modular office, will facilitate completion of the registration process.
Recommendation No. 2 authorizes the Chief Probation Officer or Assistant Chief Probation Officer to execute and submit the required Power of Attorney form to the State of California Department of Housing and Community Development to complete the State registration process.
