RECOMMENDATIONS

Recommendation

Acting as the governing body of County Service Area 20 Joshua Tree:

1.                     Approve Addendum No. 1, issued on May 6, 2026, Addendum No. 2, issued on May 7, 2026, and Addendum No. 3, issued on June 10, 2026, to the bid documents for the County Service Area 20 Joshua Tree - Park Improvements at Sunburst Park and Community Park Project.

2.                     Award Construction Contract to Three Peaks Corp., for the County Service Area 20 Joshua Tree - Park Improvements at Sunburst Park and Community Park Project, in the amount of $3,061,800, with a construction duration of 180 calendar days from the Notice to Proceed.

3.                     Authorize a contingency fund of $306,180 for the County Service Area 20 Joshua Tree - Park Improvements at Sunburst Park and Community Park Project.

4.                     Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the construction contract with Three Peaks Corp., for a total amount not-to-exceed $165,590 of the $306,180 contingency fund, pursuant to Public Contract Code Section 20142.

5.                     Authorize the Director of the Department of Public Works to accept the work when 100% complete, and to execute and file the Notice of Completion.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The County Service Area (CSA) 20 Joshua Tree (District) - Park Improvements at Sunburst Park and Community Park Project (Project) is funded in full by Clean California Local Grant Program Cycle 2 grant funds in the amount of $3,774,000. Sufficient appropriation for the Project is included in the District’s 2026-27 budget and will be included in future recommended budgets as needed.

 

BACKGROUND INFORMATION

The Project at Sunburst Park and Community Park aims to transform underutilized, partially developed community spaces into vibrant, accessible, and inclusive recreational destinations for residents of Joshua Tree. Sunburst Park currently contains outdated amenities, large vacant areas that accumulate trash, and limited Americans with Disabilities Act (ADA)-accessible routes, while the Community Park’s playground is similarly outdated and not fully inclusive. These conditions reduce community use, detract from neighborhood aesthetics, and limit opportunities for physical activity and social connection. The proposed improvements, including new playgrounds, accessible walkways, enhanced lighting, landscaping, an outdoor fitness zone (Ninja Course), an asphalt concrete pump track, signage, and wastereduction infrastructure, are designed to beautify public spaces, reduce litter, improve walkability, support healthy lifestyles, and expand recreational access for an underserved community. Ultimately, the Project meets a demonstrated community need by creating safer, cleaner, more inviting parks that promote public health, cultural connections, and equitable access to local amenities.

 

On January 23, 2024 (Item No. 57), the San Bernardino County Board of Supervisors (Board) approved the Capital Improvement Program Project - CSA 20 District Project in the amount of $3,774,000.

 

At that same meeting, the Board accepted the grant award and approved Restricted Grant Agreement No. 24-108 with the California Department of Transportation for the Clean California Local Grant Program Cycle 2, for the CSA 20 District Project, in the amount of $3,774,000, effective upon the date approved by the California Department of Transportation through December 31, 2026.

 

The Board also approved Amendment No. 1 to the Restricted Grant Agreement No. 24-108 with the California Department of Transportation, amending certain sections of the agreement pertaining to the Advance Spending Plan, Scope Cost & Schedule Workbook, Engineer’s Estimate, and total project cost, with no change to the term through December 31, 2026.

 

On November 18, 2025, via Delegated Authority, Amendment No. 2 of the Restricted Grant Agreement No. 24-108 was executed to revise the milestone schedule and extend the term of the agreement to March 31, 2028.

 

On April 3, 2026, pursuant to County Policy No. 11-15, the Assistant Executive Officer (AEO) approved the Project and the Project’s plans and specifications, as well as determined that the Project was exempt under California Environmental Quality Act (CEQA). A Notice of Exemption was filed on April 9, 2026, no timely challenges were filed.

 

Since the Board's acceptance of the grant award and approval of the Capital Improvement Program Project, the Department has completed the design, obtained the necessary approvals, and conducted a competitive bidding process. This item requests Board approval of the bid addenda, award of the construction contract to Three Peaks Corp., authorization of a construction contingency, and limited delegated authority for contract administration, authorization for the Director of the Department of Public Works (Director) to order any necessary changes or additions in the work being performed under the construction contract, accept the completed work, and execute and file the Notice of Completion. Approval of these actions will allow the Department to proceed with construction of the Project.

 

PROCUREMENT

On April 3, 2026, pursuant to County Policy No. 11-15, the AEO authorized the Director of the Department of Public Works (Department) to advertise the Project for bids.

 

This Project was advertised in the Hi-Desert Star on April 22, 2026, and April 29, 2026, and in the San Bernardino County Sun on April 23, 2026, and April 30, 2026, and released on the County Electronic Procurement Network (ePro) Bid SPD126-SPDAD-6387 on April 27, 2026, in accordance with Public Contract Code Section 22037.

 

During the bidding process, the following addenda were issued:

 

Addendum No. 1: Revised Section A to include Class B Contractor’s License and include a second date for a pre-bid meeting.

 

Addendum No. 2: Included additional exhibits.

 

Addendum No. 3: Revised itemized bid section, revised bid opening date and answered submitted questions.

The lowest bidder was determined pursuant to Public Contract Code section 20103.8(b), under which the Department specified in the bid documents that the lowest bidder would be determined on the basis of the total of the Base Bid and Bid Additive Nos. 1 through 6. Three Peaks Corp.’s Base Bid was $2,319,100, and with Bid Additive Nos. 1 through 6, totaled $3,290,000.

 

The Department reviewed the Project bids received and recommends that the construction contract be awarded to Three Peaks Corp., as the lowest responsive and responsible bidder. No appeal/protest letters were received.

 

The Department has elected to move forward with Bid Additive Nos. 2, 3, 4 and 6 which total $742,700, for a total proposed contract award of $3,061,800 to Three Peaks Corp. The Project will have a contingency fund of $306,180 to compensate the Three Peaks Corp. for verified quantity overruns, as well as changes in the contract under certain circumstances. Under an established formula, Public Contract Code Section 20142 allows the Board to authorize the Director to order changes in the contract for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $165,590 of the $306,180 contingency fund.

 

Following Board approval of this item, construction is anticipated to commence Fall 2026 and be completed in Spring 2027.
