Recommendation
1. Find the vacation of non-vehicular access rights, as irrevocably offered to dedicate and accept interests along the northwesterly line of Pine Street, in the unincorporated community of Bloomington area, as an exempt action under the California Environmental Quality Act Guidelines, Title 14 of the California Regulations, sections 15061(b)(3) and 15305, Class 5 - Minor Alterations in Land Use.
2. Adopt Resolution that finds and determines that non-vehicular access rights along the northwesterly boundary of Pine Street, in the unincorporated community of Bloomington area, as described in Exhibit A and shown on Exhibit B to the Resolution, have been superseded, are excess public interests, are not necessary for present or prospective public use, and vacation achieves the public purpose of eliminating and clearing the public records of unnecessary public interests.
3. Direct the Clerk of the Board of Supervisors to forward a copy of the executed Resolution to the Department of Public Works to be recorded in the official records by the San Bernardino County Recorder.
4. Direct the Department of Public Works to file and post the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). All costs associated with processing the summary vacation of non-vehicular access rights along Pine Street are applicant-funded through the approved Road Abandonment Fee. Project costs are estimated not to exceed $12,000. Adequate appropriation and revenue have been included in the Department of Public Works’ (Department) 2025-26 recommended budget and will be included in the 2026-27 recommended budget (6650002000 TRDVA2500003).
BACKGROUND INFORMATION
This item approves the summary vacation of the County’s non-vehicular access rights along the northwesterly line of Pine Street in the unincorporated Bloomington area. These rights were irrevocably offered for dedication, accepted by the County, and shown on Tract Map No. 10783, recorded in Map Book 307, Pages 90 through 94, in the official records of San Bernardino County (County).
The non-vehicular access rights were originally established to restrict access to a vacant remainder parcel shown on Tract Map No. 10783. The current owner of that parcel, identified as Assessor Parcel Number 0259-061-06, has proposed development of a single-family residence. As part of that proposal, the Department reviewed and approved Street Improvement Plans (SIP-2024-00038), which include a Hammerhead Fire Truck Turnaround Clearance Area along the northwesterly line of Pine Street.
A Hammerhead Fire Truck Turnaround Clearance Area is a T-shaped space that allows emergency vehicles to safely turn around at the end of a dead-end road or long driveway. To allow this improvement and provide access along the northwesterly line of Pine Street, the existing non-vehicular access restriction must be removed.
The Department has reviewed the vacation request and recommends a finding and determination that the non-vehicular access rights have been superseded and are excess public interests that are not necessary for present or prospective public use. The rights proposed for vacation are described in Exhibit A (Legal Description) and shown on Exhibit B (Plat) to the Resolution.
The proposed vacation serves a public purpose by eliminating and clearing the public records of an unnecessary title encumbrance, superseded, and excess non-vehicular access interest. Upon recordation of the Resolution, the non-vehicular access rights will be vacated, allowing access along the northwesterly line of Pine Street as described in the Resolution.
The Department’s Environmental staff reviewed the request to abandon non-vehicular access rights along the northwesterly line of Pine Street and has determined that the request qualifies for a Categorical Class 5 Exemption (Class 5) in accordance with the California Environmental Quality Act (CEQA) Guidelines and Title 14 of the California Code of Regulations, section 15061(b)(3) is also appropriate. Class 5 consists of minor alterations in land use limitations in areas with an average slope of less than 20%, which do not result in any changes in land use or density as identified in section 15305 of Title 14 of the California Code of Regulations. Additionally, this approval is a vacation of non-vehicular rights, therefore there is no possibility that the activity may have a significant effect on the environment and qualifies for a commonsense exemption under CEQA Guidelines Section 15061(b)(3). When the Board of Supervisors (Board) considers environmental findings, the filing and posting of a Notice of Exemption is recommended.
Upon Board approval of this summary vacation action, the County will abandon the non-vehicular access rights and will allow access along the northwesterly line of Pine Street, as described in Exhibit A (Legal Description) and shown on Exhibit B (Plat) of the Resolution. A certified copy of the Board approved Resolution to Abandon the non-vehicular rights will be recorded in the office of the San Bernardino County Recorder. The vacation aligns with the County and the Chief Executive Officer’s goal of ensuring development of a well-planned, balanced, and sustainable County by removing superseded and excess non-vehicular access rights.
