RECOMMENDATION(S)

Recommendation

1.                     Conduct a public hearing to consider Project No. 2022-00216 consisting of a Policy Plan Amendment, Zoning Amendment, Tentative Parcel Map, and Planned Development Permit for a 12.46-acre site and adopt a declaration of intent to:

a.                     Adopt the Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program.

b.                     Adopt the findings recommended by the Planning Commission in support of the Policy Plan Amendment, Zoning Amendment, Tentative Parcel Map, and Planned Development Permit.

c.                     Adopt the Policy Plan Amendment to amend the Land Use Category designation from Rural Living to Commercial on a 12.46-acre parcel.

d.                     Adopt the Zoning Amendment to amend the Land Use Zoning District designation from Rural Living to Highway Commercial on a 12.46-acre parcel.

e.                     Approve Tentative Parcel Map No. 20876 to subdivide a 12.46-acre parcel into 14 parcels in six phases, subject to the Conditions of Approval.

f.                     Approve the Planned Development Permit to construct and operate an integrated commercial shopping center in six phases consisting of electric vehicle charging stations, nine standalone retail and commercial structures of up to 40,670 total square feet, and associated infrastructure and improvements over 14 parcels with alterations to minimum and maximum lot, setbacks, landscaping, and circulation standards on a 12.46-acre site, subject to the Conditions of Approval.

g.                     Direct the Land Use Services Department to file the Notice of Determination in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Adequate appropriation and revenue to complete this action have been included in the Land Use Services Department Planning Division 2026-27 budget. All costs of processing this application are paid by the Applicant.

 

 

BACKGROUND INFORMATION

This item consists of a request for a Policy Plan Amendment, Zoning Amendment, Tentative Parcel Map, and Planned Development Permit for the development of the proposed Yermo Eddie's World Tesla Project as follows:

                     Policy Plan Amendment from Rural Living (RL) to Commercial (C) for a 12.46-acre parcel.

                     Zoning Amendment from Rural Living (RL) to Highway Commercial (CH) for a 12.46-acre parcel.

                     Tentative Parcel Map No. 20876 to subdivide a 12.46-acre parcel into 14 parcels in six phases.

                     Planned Development Permit (PDP) for the construction and operation of an integrated commercial shopping center in six phases consisting of electric vehicle charging stations, nine standalone retail and commercial structures up to 40,670 total square feet, and associated infrastructure and improvements over 14 parcels with alterations to minimum and maximum lot, setbacks, landscaping, and circulation standards on a 12.46-acre site (collectively the Project).

 

In accordance with Development Code Subsection 82.04.040(b), shopping centers are permitted uses within the CH zoning district, subject to the approval of a use permit. As referenced above, the PDP is for a six-phase integrated commercial shopping center. The PDP provides flexibility from the CH development standards to accommodate the Project’s unified, multi-tenant, phased design. Specifically, the PDP modifies the minimum lot area from five acres to as little as 0.13 acre; minimum lot width from 120 feet to 100 feet; minimum lot depth from 120 feet to 33 feet; front setback from 25 feet to 12 feet; street-side setback from 25 feet to 10 feet; maximum lot coverage from 80 percent to 85 percent; and minimum landscaping from 20 percent to 15 percent of the site. The interior side and rear setbacks remain at the required 10 feet, and the maximum width-to-depth ratio remains 1:3. The Project also proposes 28- and 30-foot-wide drive aisles, exceeding the minimum 26-foot width, to facilitate site circulation and emergency access. The Project would operate as a unified development, with each phase required to provide the infrastructure and improvements necessary for independent operation, and includes residential buffering, roadway and circulation improvements, and mitigation measures addressing identified environmental impacts. A detailed and comprehensive analysis of the Project from a planning and land use perspective is included within the Planning Commission Staff Report and attached as a supporting document to this item.

 

The Project has been analyzed with the preparation of an Initial Study/Mitigated Negative Declaration (MND). The MND concludes that the Project will not have a significant impact on the environment with the adoption of feasible mitigation measures addressing cultural and tribal cultural resources, transportation, and noise, which are attached as a supporting document to this item.

 

The Development Code requires a recommendation from the San Bernardino County Planning Commission (Planning Commission) for final action by the Board of Supervisors (Board) on the Policy Plan Amendment, Zoning Amendment, and Planned Development Permit. At the Planning Commission hearing on May 21, 2026, there were no in-person public comments. The Planning Commission recommended approval of the Project by a vote of 3-0 (Commissioners Stoffel and Weldy absent). The Planning Commission’s recommendation and proposed findings are included within the Planning Commission Staff Report and attached as a supporting document to this item.

 

This item is a declaration of intent item and, if approved, will be continued for final action as part of the Third Cycle 2026 Policy Plan Land Use Element Amendment included on the Board’s September 22, 2026, agenda.
