Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District:
1. Approve the termination of Lease Agreement No. 07-578 with San Bernardino International Airport Authority for approximately 4,338 square feet of hangar storage space known as Hangar No. 763, located at the San Bernardino International Airport, which expired on August 31, 2022, and has since continued on a permitted month-to-month holdover period, by delivering a notice to terminate the holdover period pursuant to the lease, with an effective termination date of July 31, 2023.
2. Authorize the Director of the Real Estate Services Department to deliver to San Bernardino International Airport Authority a notice to terminate the holdover period under Lease Agreement No. 07-578, with an effective termination date of July 31, 2023, for approximately 4,338 square feet of hangar storage space, known as Hangar No. 763, located at the San Bernardino International Airport.

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the recommendation is for the termination of Lease Agreement No. 07-578 (Lease), which will confirm the final date of the Lease.
BACKGROUND INFORMATION
The recommended action will terminate the Lease with San Bernardino International Airport Authority (SBIAA) for approximately 4,338 square feet of hangar space (Hangar No. 763), located at the San Bernardino International Airport in San Bernardino. The lease expired on August 31, 2022, and has since continued on a permitted month-to-month holdover period. The effective termination date of the lease will be July 31, 2023.
On July 17, 2007 (Item No. 24), the Board of Supervisors approved Lease Agreement No. 07-578, for the San Bernardino County Fire Protection District (SBCFPD), to lease 10,681 square feet of hangar storage space in Hangar No. 763 and 60,480 square feet of unimproved land with SBIAA in San Bernardino. The original term of the Lease was for the period of May 1, 2007 through April 30, 2008. In the 16 years since the Lease was originally approved, the Board of Supervisors and the Board of Directors (Board) for SBCFPD have collectively approved 13 amendments to modify the rental rate schedule, reduce the square footage, delete unimproved land from the leased premises, exercise options to extend the term of the lease through August 31, 2022, add options to extend the term of the lease, and update standard lease agreement language.

While the Lease expired on August 31, 2022, SBCFPD remained at Hangar No. 763 on a month-to-month holdover period, as permitted by the Lease, on the same terms and conditions as the Lease, including the monthly rent as it existed in the month prior to the expiration date. Either party has the right to terminate the Lease with one month’s notice during any holdover period.
In 2022, Hangar 763 underwent environmental testing for lead. As a result, the District cleaned the affected supplies and equipment in the hangar and sought new premises to relocate.
On February 7, 2023 (Item No. 50), the District Board approved a lease with CCI Club SB LLC, a Colorado limited liability company, for a total of approximately 23,154 square feet as relocation space for SBCFPD.
On April 11, 2023, the District notified the Real Estate Services Department (RESD) that the use of Hangar No. 763 was no longer necessary for SBCFPD operations at SBIAA and requested that RESD obtain the Board’s authorization to terminate the permitted holdover period under the Lease by delivering a termination notice to the SBIAA. The District and RESD request that the Lease be terminated effective July 31, 2023, by the Director of RESD delivering a termination notice to SBIAA. This item will approve a termination pursuant to the provisions of the Lease.
