RECOMMENDATION(S)
Recommendation
1. Approve Memorandum of Agreement with the Mojave Desert Air Quality Management District to establish procedures for acceptance of Assembly Bill 2766 funds, in the annual amount of $75,000, for a total amount of $375,000, for the Employee Rideshare Program, for the period of July 1, 2023, through June 30, 2028.
2. Authorize the Director of Human Resources to annually sign and submit the Scope of Work and Annual Report to the Mojave Desert Air Quality Management District, as required by the Memorandum of Agreement.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Costs). The Mojave Desert Air Quality Management District (MDAQMD) receives Assembly Bill (AB) 2766 fee revenues collected by the Department of Motor Vehicles. MDAQMD has allocated $75,000 per year for the period of July 1, 2023 through June 30, 2028, to San Bernardino County (County) to provide for the County’s Employee Rideshare Program for those employees that reside in the MDAQMD jurisdiction. MDAQMD revenues will be included in the Human Resources Department (Human Resources) Commuter Services 2023-24 recommended budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
AB 2766 was chaptered into law as Health and Safety Code Sections 44220-44247 to authorize air pollution districts to impose fees on motor vehicles. Fees collected are to be expended for the purpose of air pollution reduction measures pursuant to the California Clean Air Act of 1988.
MDAQMD has disbursed a portion of the AB 2766 funding they receive to the County since 1996. The County has utilized these funds to operate the program for the benefit of encouraging and incentivizing employees to ride share in order to reduce air pollution from motor vehicles. The program includes marketing, rideshare matching, subsidies for eligible carpools, vanpools, and transit programs, as well as incentives and recognition for ongoing participation.
On December 18, 2018 (Item No. 34), the Board of Supervisors approved Memorandum of Agreement No. 18-897 with MDAQMD, agreeing to the new requirement to submit a Scope of Work and Annual Report for each fiscal year that AB 2766 funds are received. This requirement has been completed each year by Human Resources.
Approximately 18% of all County employees reside within the MDAQMD jurisdiction. The program had 581 participants in 2022-23, of which 21% reside within the MDAQMD jurisdiction. Program costs specific to the proportion of County employees and participants who reside within the MDAQMD jurisdiction have been identified and will meet or exceed the funding received from MDAQMD. The remaining funding for the program is supplied by AB 2766 disbursements from the South Coast Air Quality Management District.
This item will allow the County to continue to receive MDAQMD funds and for the Director of Human Resources to annually sign and submit the Scope of Work for Commuter program activities and Annual Report to the MDAQMD as required by the Memorandum of Agreement.
