RECOMMENDATION(S)

Recommendation

1.                     Find that approval of Amendment No. 5 to Lease Agreement No. 17-278 with the City of Barstow for office space, is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).

2.                     Approve Amendment No. 5 to Lease Agreement No. 17-278 with the City of Barstow to:

a.                     Extend the term of the Lease Agreement for the period of September 1, 2026 through August 31, 2027, by exercising the existing one-year option to extend.

b.                     Add one five-year option to extend the term of the lease.

c.                     Adjust the rental rate schedule.

d.                     Increase the contract amount by $6,802, from $38,385 to a new total amount of $45,187.

e.                     Update standard lease agreement language.

f.                     Continue leasing approximately 401 square feet of office space located at 681 North First Street, Suite 212 (Assessor's Parcel Number 0181-021-20-0000) in Barstow, for the Workforce Development Department.

3.                     Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  The Workforce Development Department (WDD) lease costs are federally funded through the Workforce Innovation and Opportunity Act (WIOA).  The total cost of Amendment No. 5 (Amendment) to Lease Agreement No. 17-278 (Lease) is $6,802.  Lease payments will be made from the Real Estate Services Department (RESD) Rents budget (7810001000) and reimbursed from the WDD budget (5711942260).  Sufficient appropriation is included in the 2026-27 budget and will be included in future recommended budgets.  Annual lease costs are as follows:

BACKGROUND INFORMATION

On May 23, 2017 (Item No. 103), the Board of Supervisors (Board) approved the Lease with the City of Barstow for approximately 217 square feet of office space located at 681 North First Street, Suite 212 in Barstow, with two one-year options to extend.  In the nine years since the Lease was originally approved, the Board has approved four amendments to extend the term, expand the leased premises to 401 square feet, adjust the rental rate, add options to extend the term of the Lease, and update standard lease agreement language.

WDD requested that RESD process an amendment to exercise the existing one-year option to extend the Lease term for the period of September 1, 2026 through August 31, 2027.  Pursuant to the terms of the Lease, the rental rate for the extension period was previously established and will be $566 per month through August 31, 2027.  The Amendment will also add one five-year option to extend the Lease term.  In addition, the Amendment updates the mutual indemnification provisions and adds a hazardous substances provision to clarify each party's respective responsibilities under the Lease.  All other terms remain unchanged.

 

The project to approve the Amendment was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under Section 15301 - Existing Facilities (Class 1) because the Lease is for continued occupancy and operation within an existing facility and the Amendment will not result in any expansion of use or physical changes to the environment.

PROCUREMENT

County Policy 12-02 does not apply to leases of real property owned by a federal agency, the State, a city, a county, a school district, special district, or other public entity.  The Board shall, as required by law, approve all such leases.
