FINANCIAL IMPACT
This item does not impact Discretionary General Funding (Net County Cost). The amount of the revenue contract with the State of California Department of State Hospitals (DSH) for the Diversion Opportunity for Outpatient Recovery Services (DOORS) Program services is unchanged at $7,464,800. The required 20% ($1,492,960) local match will be satisfied through in-kind services provided by Department of Behavioral Health (DBH) program staff. Adequate appropriation and revenue have been included in DBH’s 2023-24 budget and will be included in the 2024-25 recommended budget.
BACKGROUND INFORMATION
DBH is responsible for providing mental health and substance use disorder treatment services to county residents who are experiencing major mental illness and/or substance use disorders. An integral part of the service delivery system consists of effective alternatives to incarceration for individuals who are arrested and jailed in relation to their mental health illness and/or substance use disorder.
DOORS allows individuals with a serious mental illness or co-occurring disorders (mental illness and a substance use disorder) to receive pre-trial diversion treatment in the community, or to receive competency supportive services where those are considered to be Incompetent to Stand Trial (IST). This program was developed by DBH with the support of Law & Justice Group partners: County Superior Courts, Sheriff’s Department, Public Defender’s office, District Attorney’s office, and the Probation Department.
The funds from this revenue agreement will be utilized for the DOORS program, a unit within DBH’s Adult Forensic Services Division established to provide diversion services. The program anticipated serving a minimum of 53 clients during the contract period; to date, the program has provided services to 84 clients. The DOORS population is determined by California State Welfare and Institution Code 4361, Senate Bill 215, and California Penal Code 1368/1370, which requires county courts to establish a pre-trial diversion program.
The DBH Adult Forensic Services Division began providing diversion services in 2018, for adults who have been charged with a felony or misdemeanor in the County and referred for community-based diversion or restoration of competency services for those deemed to be IST or likely to be found IST. These are individuals with a severe mental illness, such as schizophrenia, schizoaffective disorder, and/or bipolar disorder who can be treated in the community under the court’s supervision, as opposed to being treated in jails and/or state hospitals.
On October 30, 2018, the County Administrative Office authorized the submission of a County Letter of Intent to Apply for Funding for the Pre-Trial Felony Mental Health Diversion Programs from DSH in the amount of $7,464,800, for the period of January 10, 2020 through January 9, 2023.
On March 24, 2020 (Item No. 17), the Board of Supervisors (Board) approved Revenue Agreement No. 20-139 (State Agreement No. 19-79012-000) with DSH in the amount of $7,464,800, for the period of January 10, 2020 through January 9, 2023.
On April 26, 2022 (Item No. 16), the Board approved Amendment No. 1 to Revenue Agreement No. 20-139 (State Agreement No. 19-79012-000-A1), extending the contract period by one year, with no change to the contract amount of $7,464,800, for the total contract period of January 10, 2020 through January 9, 2024.
Approval of this item will allow DBH to continue services through the revised contract expiration date of January 9, 2025. DBH was notified on October 19, 2023 of the amendment, which allows for the extension and for the implementation of a permanent Felony IST state contract. It is being brought forward for approval by the Board at this time after the required program, legal, and administrative reviews.
