RECOMMENDATION(S)

Recommendation

1.                     Find that approval of Amendment No. 1 to License Agreement No. 16-895 with Family Service Association for approximately 5,406 square feet of kitchen space, a multi-purpose room, office space, and parking lot, is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).

2.                     Find that approval of Amendment No. 1 to License Agreement No. 16-895 with Family Service Association is in the best interest of county residents and serves a public health and welfare purpose by meeting the social needs of the population of the County.

3.                     Approve Amendment No. 1 to License Agreement No. 16-895 with Family Service Association to:

a.                     Extend the term of the License Agreement for one year, for the period of July 1, 2026 through June 30, 2027, with three one-year automatic extensions, unless earlier terminated by written notice by either party, with no fee.

b.                     Continue the non-exclusive use of approximately 5,406 square feet consisting of kitchen space, a multi-purpose room, office space, and parking areas within the George White Center, located at 8565 and 8585 Nuevo Avenue in Fontana, with no fee, for the preparation and service of meals to the senior community, pursuant to Government Code section 26227.

4.                     Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT

Approval of this item will not require the use of Discretionary General Funding (Net County Cost).  Amendment No. 1 (Amendment) to License Agreement No. 16-895 (License) is a no-cost agreement and no license fee will be charged to Family Service Association (FSA).  FSA will be responsible for all maintenance, janitorial, and utility costs associated with the licensed space. 

 

BACKGROUND INFORMATION

FSA is a private, not-for-profit, human service organization that has been serving the needs of individuals, families and communities since 1953.  FSA has been providing meals to 3,500 older adults per day throughout Riverside and San Bernardino Counties through the Meals on Wheels program, which includes Fontana and surrounding communities. 

 

On November 15, 2016 (Item No. 44), the Board of Supervisors (Board) approved the License with FSA for the non-exclusive use of approximately 5,406 square feet consisting of kitchen space, a multi-purpose room, office space, and parking areas within the George White Center in Fontana (Licensed Space) at no fee, as the Older Californian Nutrition Program service provider, commencing December 1, 2016 through June 30, 2019.

 

The George White Center was originally purchased with Community Development Block Grant (CDBG) funds in 1986 for the purpose of providing older adult meal services to low-to-moderate income residents.  Department of Aging and Adult Services (DAAS) is responsible for ensuring the facility continues to be used for approved senior meal services.

 

The License operated in a permitted month-to-month holdover status from July 1, 2019 through June 30, 2026, while the County evaluated DAAS ongoing operational requirements, community service needs, funding sources, budgetary considerations, and responsibilities for the maintenance and operation of the County-owned facility.  Following completion of those evaluations and confirmation of the continued need for the licensed use of the premises, DAAS requested that the Real Estate Services Department (RESD) negotiate a one-year License extension with FSA to allow continued non-exclusive use of the Licensed Space.

 

The recommended action approves the Amendment with FSA, extending the term for one year, from July 1, 2026 through June 30, 2027, with three one-year automatic extensions, unless earlier terminated by written notice by either party.  Other than term extension and administrative updates, the License terms remain unchanged.  Either party may terminate the License with 90-days’ written notice.

 

This project was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be exempt from future environmental review in accordance with a Class 1 Exemption pursuant to Section 15301 of the CEQA Guidelines.

PROCUREMENT

California Government Code section 26227 authorizes the County to grant the use of real property to private entities for programs that serve a public purpose by meeting the public health, welfare, and public service needs of the County and the general public.
