RECOMMENDATION(S)

Recommendation

Acting as the governing body of the San Bernardino County Fire Protection District:

1.                     Find that approval of the non-financial License Agreement with Angelus Oaks Fire Safe Council, for San Bernardino County Fire Protection District real property is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).

2.                     Find that the non-financial License Agreement with the Angelus Oaks Fire Safe Council for use of San Bernardino County Fire Protection District real property serves a public health and safety purpose and is in the best interest of County residents, as the property will be used for storage of lifesaving equipment available for mutual aid response.

3.                     Approve non-financial License Agreement for use of approximately 1,000 square feet of land at Fire Station 98, located at 5766 Frontage Road in Angelus Oaks (Assessor’s Parcel Number 0305-07-220-0000), for the period of June 23, 2026 through June 22, 2031, with no license fee, and with three successive five-year options to extend the term.

4.                     Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  Approval of the non-financial License Agreement (License) with the Angelus Oaks Fire Safe Council (AOFSC), for use of approximately 1,000 square feet of land at Fire Station 98, located at 5766 Frontage Road in Angelus Oaks [Assessor’s Parcel Number (APN) 0305-07-220-0000] (Property), will have no impact to the San Bernardino County Fire Protection District (SBCFPD) budget.  The License is provided at no cost to AOFSC, and no revenue will be generated to SBCFPD.  Any minimal administrative costs associated with processing and oversight of the License will be absorbed within SBCFPD’s Mountain Service Zone budget (6000042448).

 

BACKGROUND INFORMATION

The AOFSC is a community-based organization that supports wildfire preparedness, emergency response, and resilience efforts within the mountain region of the County.  AOFSC assists with mutual aid response, local emergency support, and community readiness activities, including staging firefighting equipment and snow response apparatus necessary for mountain operations.

 

The proposed License authorizes AOFSC to utilize the Property for placement of temporary, movable eight-foot by 40-foot storage containers.  The containers have historically been located on the Property and were grandfathered when the land was transferred to SBCFPD on June 20, 2008. 

 

The containers will be used solely for storage of firefighting equipment and emergency response apparatus, including snowcats and a snow motor grader, in support of wildfire and winter emergency operations.  No grading, excavation, or removal of soil is proposed.  Any required permits or land use approvals will be obtained from the County’s Land Use Services Department prior to placement or modification of any container.  Approval of the proposed License formalizes the continued use of SBCFPD property for community wildfire resilience and emergency response support in the mountain region.  The License is provided at no cost due to the direct public safety benefit received by SBCFPD, including enhanced emergency response capabilities and equipment staging.  The value of these services was considered to offset any potential rental revenue.

 

The project was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under CEQA Section 15301 - Existing Facilities (Class 1), as the action involves continued use of existing site conditions, with no expansion of use, and placement of temporary, moveable structures.

PROCUREMENT

California Government Code section 26227 authorizes SBCFPD to grant the use of real property to private entities for programs that serve a public purpose by meeting the public safety, health, and public service needs of the County and the general public.
