RECOMMENDATION(S)
Recommendation
1. Find that approval of Revenue License Agreement with Consolidated Fire Agencies, for the non-exclusive use of Rack and Antenna Space at 15900 Smoke Tree Street, known as the High Desert Government Center in Hesperia is exempt under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).
2. Find that approval of Revenue License Agreement with Consolidated Fire Agencies, for the non-exclusive use of Rack and Antenna Space at 15900 Smoke Tree Street, known as the High Desert Government Center in Hesperia, is in the public interest and will not substantially interfere with the County’s existing or future use of the property.
3. Approve Revenue License Agreement with Consolidated Fire Agencies, for the non-exclusive use of Rack and Antenna Space at 15900 Smoke Tree Street, known as the High Desert Government Center (Assessor’s Parcel Number: 0407-224-02-0000) in Hesperia to:
a. Approve the term of the Revenue License Agreement for the period of July 1, 2026 through June 30, 2031.
b. Approve a total Revenue License Agreement of $109,736.
4. Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not require Discretionary General Funding (Net County Cost). The total revenue to be received by the County during this Revenue License Agreement (License) is $109,736, which includes license revenue of $109,236 and a one-time administrative fee of $500. Revenue will be deposited in Real Estate Services Department (RESD) Rents budget (7810001000). Annual revenue effective July 1, 2026 is as follows:

BACKGROUND INFORMATION
The recommended action will provide for a new License with Consolidated Fire Agencies (CONFIRE) for the period of July 1, 2026 through June 30, 2031, for communications rack spaces in the County-owned server room and shared space for equipment in the communication rooms at the High Desert Government Center (HDGC), located at 15900 Smoke Tree Street (Assessor’s Parcel Number 0407-224-02-0000) in Hesperia (Premises), for the operation and maintenance of an electronic service system.
CONFIRE occupies approximately 3,441 square feet of office space situated in the County-owned HDGC for the operation of its 9-1-1 call center (call center) under the provisions of revenue Lease Agreement No. 19-505, as approved by the Board of Supervisors (Board) on July 23, 2019 (Item No. 36). The call center is linked electronically with various fire agencies in the Hesperia/Victorville area for data transmission.
On June 2, 2020 (Item No. 33), the Board approved Revenue License Agreement, No. 20-326, with CONFIRE for rack and antenna tower space at the County-maintained communication site located at HDGC in Hesperia, for the period of July 1, 2020 through June 30, 2025. CONFIRE remained in month-to-month occupancy at the HDGC through June 30, 2026 while CONFIRE evaluated integrating business operations into the Valley Communication Center.
The recommended action will approve the License with CONFIRE for the non-exclusive use of Rack and Antenna Space located at the Premises, for the period of July 1, 2026 through June 30, 2031. The License includes three five-year options to extend the License with the same terms.
The proposed License with CONFIRE was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under Section 15301 - Class 1 Existing Facilities because approval of a license for existing facilities is an exempt activity under CEQA. There is no possibility that the License of the subject property will have a significant effect on the environment; therefore, the activity is exempt from the provisions of CEQA.

PROCUREMENT
The County can grant the license to CONFIRE, a public agency, upon a finding by the Board that the conveyance is in the public interest and that the interest in land conveyed will not substantially conflict or interfere with the use of the property by the County, in accordance with Government Code Section 25526.6.
