RECOMMENDATION(S)
Recommendation
Acting as the governing body of the San Bernardino County Flood Control District:
1. Find that approval of Expense License Agreement with Greenspot Corridor, LLC, for non-exclusive use of the parking lot, is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).
2. Approve Expense License Agreement with Greenspot Corridor, LLC through the use of an alternative procedure in lieu of a Formal Request for Proposals as allowed per County Policy 12-02 - Leasing Privately Owned Real Property for County Use, to:
a. Authorize the non-exclusive use of a parking lot for San Bernardino County Flood Control District use, located on the northeast corner of Greenspot Road and Santa Ana Canyon Road near Seven Oaks Dam, in Highland.
b. Establish a two-year term from July 1, 2026 through June 30, 2028, with two one-year options to extend.
c. Approve total expenses in the amount of $24,000 over the two-year term.
3. Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (FCD) is funded by property tax revenue, fee revenue, and other local, state, and federal funding. Total expenses for the License Agreement (License) over the two-year term are $24,000. License expenses will be paid by FCD property tax revenue. Sufficient appropriation and revenue are included in FCD’s 2026-27 recommended budget (1930002526 F99913) and will be included in future recommended budgets. Annual expenses are as follows:

BACKGROUND INFORMATION
Due to impacts from the Line Fire burn scar and multiple storm events since 2024, access roads and FCD facilities have been inundated with debris and sediment.
These conditions have impaired access, increased maintenance demands, and necessitated heavy equipment operations for debris removal, road restoration, and facility upkeep to ensure the dam continues to function effectively for public safety and flood risk reduction. The Dam is owned and operated through a Joint Operation program between Orange County Flood Control (OCFC), Riverside County Flood Control and Water Conservation (RCFCWC), and FCD.
To support ongoing and accelerated maintenance activities in the affected burn scar area, FCD requires a safe, secure location to stage heavy equipment and facilitate efficient delivery of additional equipment and materials. FCD has identified a suitable parcel, Assessor’s Parcel Number 0297-061-54-0000, that provides ample space for staging and secure accessibility. This lot is within visual distance of 24-hour contracted security for the Dam facility. The identified parcel allows for FCD to save on any additional security and transportation costs instead of staging the equipment at an offsite County Public Works facility.
Parking and staging capacity for heavy equipment at the North Lena location has been reduced by approximately 50% due to the inclusion of fire department operations. This further limits on-site options for FCD and underscores the need for an alternative nearby location.
The proposed short-term License with Greenspot Corridor, LLC would allow FCD to stage equipment at a secure site closer to the Line Fire burn scar and Dam. Proximity reduces response times, transportation expenses, and logistical burdens while maintaining operational effectiveness.
The project to approve the License was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under CEQA Section 15301 - Class 1 Existing Facilities because the proposed License is to secure property to operate within the existing structure with negligible or no expansion of existing use. Accordingly, no further action is required under CEQA.

PROCUREMENT
FCD may enter into the License Agreement with the Greenspot Corridor, LLC for FCD’s use of a parking lot in accordance with Water Code Appendix Section 43-6 and County Policy 12-02. Policy 12-02 which provides that the Board may approve the use of an alternative procedure to the use of a formal Request for Proposals (RFP) whenever the Board determines that compliance with the formal RFP requirements would unreasonably interfere with the financial or programmatic needs of the District, or when the use of an alternative procedure would otherwise be in the best interests of the District.
