Recommendation
Approve Contracts with the following agencies to provide Counseling Services to Probation youth aged 11 to 25, in an aggregate amount not to exceed $1,600,000, for the total contract period of July 1, 2022 through June 30, 2027:

FINANCIAL IMPACT
This item will not result in the use of additional Discretionary General Funding (Net County Cost). The total cost of the counseling services contracts will not exceed an aggregate amount of $1,600,000 for the total contract period of July 1, 2022 through June 30, 2027, and is entirely funded through Juvenile Justice Crime Prevention Act (JJCPA) funds. The Probation Department (Probation) receives JJCPA funds annually from the State of California. Adequate appropriation and revenue have been included in Probation’s 2022-23 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
The recommended contracts will allow Probation to continue to provide counseling services to San Bernardino County youth, 11 to 25 years of age, that are on Formal Court Probation for law violations, under nonwardship Informal Probation (Welfare and Institutions Code (W&I) 654 or W&I 654.2), on Summary Probation (W&I 725), on Deferred Entry of Judgement (W&I 790), and/or at-risk of entering the Juvenile Justice System. Counseling services will also be provided to youth ages 18 to 25 who are on Formal Adult or Juvenile Probation, or on California Department of Juvenile Justice (DJJ) post discharge (reentry) supervision. Probation has provided counseling services through contracted providers since 2002 and continues to provide these services to the following geographic areas within the San Bernardino County: East Desert, North Desert, Mountain East, Mountain West, Central Valley, East Valley and West Valley.
Pursuant to JJCPA, the Juvenile Justice Coordinating Council prepares a Comprehensive Multi-Agency Plan (Plan), which is submitted to, and approved by, the California Board of State and Community Corrections every year. As part of the Plan, Probation utilizes a portion of the JJCPA funding to contract for counseling services provided to Probation and at-risk youth in all geographic areas of San Bernardino County.
Under the recommended contracts, qualified counselors will provide counseling services and treatment plans to youth who have committed delinquent acts or are at-risk of committing delinquent acts and their families. Counseling services contracts are designed to support youth and their families who do not have any other method to pay for the services.
Each contract is written in an aggregate amount not to exceed $1,600,000 for the five-year contract period. The contracts are written in this manner to establish a Board of Supervisors’ approved list of qualified agencies to allow Probation the flexibility of selecting the agency that best meets County and client service needs. The contracts will serve the following geographic areas.

The recommended contracts do not include a guaranteed minimum or maximum number of referrals and will be paid on a fee-for-service basis. The contracts may be terminated without cause by both the County or contractor, with 30-days written notice to the other party. County staff will monitor contractor invoices at both the individual and aggregate levels to ensure total payments do not exceed the authorized amounts. Contractor performance will be monitored by review on monthly reports and annual monitoring by County staff to ensure compliance with the administrative, program, and fiscal terms and conditions of each contract.
PROCUREMENT
On February 23, 2022, the County Administrative Office approved and authorized the release of a Request for Proposals (RFP) in the Electronic Procurement Network (ePro), Bid No. PROB22-PROB-4346, to solicit proposals from interested and qualified agencies to provide counseling services countywide for a period of five years. The RFP was publicly advertised through direct mailings to agencies with related experience and posted on ePro.
Twenty agencies attended the non-mandatory proposal conference on March 9, 2022. Ten proposals were received in response to the RFP by the established deadline. Proposals from the 10 agencies listed in the Recommendation met the minimum requirements and were evaluated by a team of representatives from Probation based on the selection criteria listed in the RFP.
Based on the evaluation results, all 10 agencies that submitted proposals are recommended for contracts. No written protests were received.
