RECOMMENDATION(S)

Recommendation

1.                     Find that approval of a conveyance of a non-exclusive easement to Southern California Edison Company is an exempt project under the California Environmental Quality Act Guidelines, Section 15312 (Surplus Government Property Sales) and Section 15061(b)(3) (Common Sense Exemption).

2.                     Adopt Resolution declaring the conveyance of a non-exclusive easement totaling approximately 1,721 square feet over portions of County-owned property (portions of Assessor’s Parcel Numbers 1026-081-12-0000 and 1026-081-10-0000) located at Chino Airport in the City of Chino, to the Southern California Edison Company for underground electrical utilities is in the public interest; finding the easement interest conveyed will not substantially conflict or interfere with the County’s use of the property; and authorizing the conveyance by Grant of Easement in accordance with Government Code section 25526.6 at no cost.

3.                     Approve the Grant of Easement to convey said easement to the Southern California Edison Company.

4.                     Authorize the Director of the Real Estate Services Department to execute any other non-substantive documents necessary to complete this transaction, subject to County Counsel review.

5.                     Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  The non-exclusive easement will be granted to the Southern California Edison Company (SCE) at no cost pursuant to Government Code section 25526.6.  SCE will be responsible for the maintenance of the easement area and the construction, operation, and maintenance of its improvements within the easement area as required by the Grant of Easement.  Internal administrative costs incurred by the County’s Real Estate Services Department (RESD) to process this easement will be paid by Airports cost center (6315001000).

 

BACKGROUND INFORMATION

The proposed easement over portions of the County-owned Chino Airport (Airport) will allow SCE to install, operate, and maintain electrical infrastructure necessary to provide electrical power in support of an Airport tenant’s development project on its leasehold.  The requested easement is non-exclusive and will not substantially conflict or interfere with Airport operations.  The conveyance is in the public interest because utility improvements benefit Airport property.

 

The proposed conveyance consists of one non-exclusive easement totaling approximately 1,721 square feet over portions of County-owned property portions of Assessor’s Parcel Numbers (APNs) 1026-081-12-0000 and 1026-081-10-0000 at the Airport.  The easement will be used for underground electrical utility purposes.

 

RESD reviewed the requested easement with the Department of Airports and determined that the proposed conveyance is in the public interest and will not substantially conflict or interfere with the County use of the property.  The easement will be conveyed to SCE at no cost pursuant to Government Code section 25526.6.

 

Additionally, this item will authorize the RESD Director to execute other non-substantive documents, including but not limited to disclosures, application forms, and other non-binding documents necessary to complete this transaction, subject to County Counsel review.  The RESD Director will not be authorized to execute any documents that would bind the County to any actions not contemplated by, or arising from, the transaction which is the subject of these recommendations.

 

The conveyance of the easement was reviewed pursuant to the California Environmental Quality Act (CEQA) and was determined to be categorically exempt from further environmental review under California Code of Regulations Sections 15312 (Surplus Government Property Sales) and 15061(b)(3) (Common Sense Exemption) of the CEQA Guidelines.  The easement area is not located in an area of statewide, regional, or area-wide concern as identified in Section 15206(b)(4).  Additionally, the Common Sense Exemption applies when it can be seen with certainty that there is no possibility that the conveyance may have a significant effect on the environment.  The filing of a Notice of Exemption by RESD will complete CEQA compliance for this action.

 

PROCUREMENT

The County can convey the easement interest to SCE in accordance with section 25526.6 of the Government Code.
