RECOMMENDATION(S)
Recommendation
1. Approve Amendment No. 1 to Revenue Contract No. 18-592 (State Agreement No. 17-94607 A01) with the California Department of Health Care Services, for the provision of specialty mental health services, updating contract language, with no change to the contract amount or the total period of July 1, 2017 through June 30, 2022.
2. Authorize the Director of the Department of Behavioral Health, as the County Mental Health Director, to execute amendments to Revenue Contract No. 18-592 (State Agreement No. 17-94607 A01), as required by the California Department of Health Care Services, subject to County Counsel review.
3. Direct the Director of the Department of Behavioral Health, as the County Mental Health Director, to transmit all documents and amendments in relation to Revenue Contract No. 18-592 (State Agreement No. 17-94607 A01) to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
This item does not impact Discretionary General Funding (Net County Cost). The Revenue Contract (State Agreement No. 17-94607 A01) with the California Department of Health Care Services (DHCS) outlines the terms and conditions to obtain Federal Financial Participation (FFP) reimbursement of specialty mental health services expenditures to eligible Medi-Cal beneficiaries. FFP reimburses 56.2% of the cost of specialty mental health services with the remaining funding provided through 1991 and 2011 Realignment. Adequate appropriation and revenue have been included in the Department of Behavioral Health’s (DBH) 2021-22 budget.
BACKGROUND INFORMATION
DBH is responsible for providing mental health and substance use disorder treatment services to San Bernardino County residents who are experiencing severe and persistent mental illness, substance use, and other addictions. DBH accomplishes this through a continuum of care of county operated clinics, fee for service, and contracted service providers. This amendment incorporates revisions to the agreement to change the Code of Federal Regulations Title 42 California and California Welfare and Institutions Code references, removal and update of Behavioral Health Information Notice references, and inclusion of applicable Regulation Title where not previously referenced to bring the agreement in line with requirements from the Centers for Medicare and Medicaid Services.
The County’s Mental Health Plan (MHP) is required by federal and state law and outlines the type of Medi-Cal specialty mental health services to be delivered by California counties. An integral part of this service delivery system is the continued administration and management of the MHP.
Since 1998, DBH has administered the County’s MHP for inpatient and outpatient Managed Care Mental Health Services for eligible residents, per Welfare and Institutions Code, Sections 5775-5783 that established managed mental health care plans for California counties. Per the MHP, and in order to receive reimbursement of eligible specialty mental health services, DBH is required to provide, arrange, and pay for all medically necessary covered inpatient and outpatient mental health services. This includes the management of administrative requirements such as provider oversight, credentialing, claiming, quality management, and compliance monitoring.
On August 21, 2018 (Item No. 18), the Board of Supervisors (Board) approved Revenue Contract No. 18-592 (State Agreement No. 17-94607) with DHCS, for the period of July 1, 2017 through June 30, 2022.
On May 3, 2022, DBH received the notification and contract documents from DHCS. Approval by the Board at this time does not impact the reimbursement of specialty mental health services expenditures.
