Recommendation

1.                     Acting as the governing body of all Board Governed County Service Areas and their Zones, approve Amendment No. 1 to Contract No. 23-653 with Kirtley Construction, Inc. dba TK Construction, for on-call maintenance and repair services for sewer collection systems and treatment facilities, including routine maintenance projects, public projects not exceeding $60,000, and emergency projects on an as-needed basis, increasing the total contract amount by $1,000,000, from $1,000,000 to an amount not to exceed $2,000,000, with no change to the contract term of July 11, 2023 through June 30, 2028 (Four votes required).

2.                     Acting as the governing body of the Big Bear Valley Recreation and Park District, approve Amendment No. 1 to Contract No. 23-653 with Kirtley Construction, Inc. dba TK Construction, for on-call maintenance and repair services for sewer collection systems and treatment facilities, including routine maintenance projects, public projects not exceeding $60,000, and emergency projects on an as-needed basis, increasing the total contract amount by $1,000,000, from $1,000,000 to an amount not to exceed $2,000,000, with no change to the contract term of July 11, 2023, through June 30, 2028 (Four votes required).

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Amendment No. 1 will increase the total contract amount by $1,000,000, from $1,000,000 to a total not-to-exceed amount of $2,000,000, with no change to the contract term. Costs associated with the recommended amendment will continue to be funded through available revenue sources of the applicable Board Governed County Service Areas and their Zones, the Big Bear Valley Recreation and Park District, and the Bloomington Recreation and Park District (collectively, the Districts). Sufficient appropriation and revenue to fund the costs of the subject services are included in the Districts’ 2025-26 budget and will be included in future recommended budgets as needed.

 

BACKGROUND INFORMATION

The Department of Public Works - Special Districts (Department) provides administrative oversight and operational management for the Districts. The Districts periodically require routine and emergency maintenance and repair services in support of sewer collection systems and treatment facilities, as well as public works projects not exceeding the amount specified in Public Contract Code section 22032(a). Historically, the Department has utilized contractors to provide these services on an as-needed basis.

 

On July 11, 2023 (Item No. 56), the Board of Supervisors and Board of Directors (collectively “Board”) approved Contract No. 23-653 with Kirtley Construction, Inc., dba TK Construction, to provide on-call maintenance and repair services for sewer collection systems and treatment facilities, including routine maintenance projects, public projects not exceeding $60,000, and emergency projects, for the period of July 11, 2023, through June 30, 2028. Maintaining on-call contractors allows the Department to reduce response times and efficiently address operational and emergency needs, helping ensure the Districts continue to operate in a fiscally responsible and business-like manner.

 

Approval of Amendment No. 1 to Contract No. 23-653 with Kirtley Construction, Inc., dba TK Construction, increasing the total contract amount by $1,000,000 from $1,000,000 to $2,000,000, will allow the Department to continue utilizing the contractor for ongoing on-call maintenance and repair services for sewer collection systems and treatment facilities, including routine maintenance and emergency repair projects, on an as-needed basis.

 

The requested increase is necessary due to the higher-than-anticipated volume of work performed under Contract No. 23-653, including emergency projects and unforeseen infrastructure repairs. Kirtley Construction, Inc., dba TK Construction has consistently provided reliable, cost-effective services and has demonstrated extensive knowledge and expertise in underground utilities, water main construction, and related infrastructure work. Increasing the contract amount will ensure sufficient funding remains available to support ongoing maintenance activities, planned projects, and emergency response needs throughout the remainder of the contract term through June 30, 2028.

 

Pursuant to Public Contract Code section 20136, amendments to contracts for construction and repair services require approval of two-thirds (four votes) of the Board.
