RECOMMENDATION(S)
Recommendation
Acting as the governing body of the San Bernardino County Flood Control District:
1. Find that approval of Amendment No. 4 to Revenue License Agreement No. 12-171 with Reche Canyon Mobile Home Estates, for the non-exclusive access to Flood Control District land, is exempt under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).
2. Approve Amendment No. 4 to Revenue License Agreement No. 12-171 with Reche Canyon Mobile Home Estates, for the continued non-exclusive use of approximately 45 square feet of Flood Control District right-of-way, located at the southwest corner of E Washington Street and Reche Canyon Road (Assessor’s Parcel Number 0164-231-24-0000) in Colton to:
a. Extend the License term from June 1, 2026 through May 31, 2031.
b. Approve a 23-month permitted holdover period from July 1, 2024 through May 31, 2026, in the amount of $2,139.
c. Approve total additional revenue of $8,183, which includes $2,139 for the permitted holdover period of July 1, 2024 through May 31, 2026, and $6,044 for the extended five-year term.
d. Increase the total contract revenue from $18,672 to $26,855.
3. Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Total revenue for Amendment No. 4 (Amendment) to Revenue License Agreement No. 12-171 (License) over the five-year term is $8,183, which includes a permitted holdover period amount of $2,139 for the period of July 1, 2024 through May 31, 2026. License revenues will be received by the San Bernardino County Flood Control District (FCD) (1920002522). Sufficient appropriation and anticipated revenue are included in FCD’s 2025-26 budget and will be included in future recommended budgets. Annual License revenues are as follows:

BACKGROUND INFORMATION
On March 13, 2012 (Item No. 54), the Board of Supervisors (Board) approved the License with Reche Canyon Mobile Home Estates (Reche Canyon) for a three-year term, with three five-year options to extend. The License commenced on March 1, 2012 through February 28, 2015. In the 14 years since the License was originally approved, the Board has approved three amendments that have updated license language and revised rent schedules. All other terms remained unchanged.

Reche Canyon entered a permitted month-to-month holdover beginning July 1, 2024 through May 31, 2026, due to timing associated with negotiations and administrative processing. During this holdover period, the monthly rent was increased by a negotiated four percent. The Real Estate Services Department (RESD) continued discussions with Reche Canyon and reached an agreement to extend the License for an additional five-year term from June 1, 2026 through May 31, 2031.
Approval of this Amendment will extend the License with Reche Canyon for non-exclusive use of signage on 45 square feet of unimproved FCD land at the Southwest corner of the intersection between Reche Canyon Road and E Washington Street in Colton, California (Property). The Amendment updates the rental rate schedule and standard license agreement language while all other terms and conditions of the License remain unchanged. The continued use of this 45 square-foot area does not interfere with FCD operations, and FCD retains the right to require relocation of the signage if necessary.
The project to approve the Amendment was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under Section 15301 - Class 1 Existing Facilities because the Amendment involves the continued use of existing facilities with negligible or no expansion of use. Accordingly, no further action is required under CEQA.
