Recommendation

Approve Amendment No. 3 to Contract No. 15-125 with Law Enforcement Medical Services, Inc., extending the contract term for one year, for a new contract period of March 17, 2015 through March 31, 2021 for the provision of medical evidence collection services.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost).  This agreement provides for cost recovery on a fee-for-service basis, therefore, the cost of the contract will vary based upon services provided. The cost for medical evidence collection services is included in the Sheriff/Coroner/Public Administrator’s (Department) and District Attorney’s 2019-20 budgets in the amounts of $460,000 and $165,500, respectively, and sufficient appropriation will be included in their 2020-21 Recommended budgets.

 

BACKGROUND INFORMATION

The Department is responsible for collecting evidence during its investigations, and the District Attorney is responsible for the payment of evidence collection services provided to the California Highway Patrol within the geographical boundaries of the County, and for payment of any necessary expert witness fees related to evidence collection.  The proposed amendment provides for an additional year of service from a qualified healthcare professional to perform on-site blood withdrawal and sexual assault suspect and victim examinations at various locations throughout the County.

 

PROCUREMENT

On March 17, 2015 (Item No. 53), as a result of a competitive process, the Board of Supervisors (Board) approved Contract No. 15-125 with Law Enforcement Medical Services, Inc. (LEMS) to provide medical evidence collection services for the period of April 1, 2015 through March 31, 2018, with the option to extend the term for two additional one-year periods. The Board subsequently approved those two options to extend the term (March 13, 2018, Item No. 45; and March 19, 2019, Item No. 39) through March 31, 2020.

 

The proposed amendment will extend the agreement with LEMS from April 1, 2020 through March 31, 2021.  This extension will provide County staff with additional time to conduct a competitive procurement for a new multi-year contract for these essential services. The agreement may be terminated by either party upon 60 days’ advance written notice.  Purchasing concurs with the extension to allow sufficient time to complete the procurement process.
