RECOMMENDATION(S)
Recommendation
1. Approve Amendment No. 1 to the Cooperative Pass-Through Agreement No. 21-276 with the City of Chino for the Kimball Avenue Drainage Improvements Project, increasing the contract amount by $415,212, from $801,600 to $1,216,812, which includes a 10% construction contingency of $97,345, and elimination all other previously approved contingencies.
2. Approve a budget increase to Capital Improvement Program Project No. 09-170, in the amount of $415,212, to increase the total project’s budget from $2,304,000 to $2,719,212, for the Chino Airport Retention and Storm Conveyance III.
3. Approve appropriation and revenue adjustments and authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, to the Department of Airports 2023-24 budget, as detailed in the Financial Impact section (Four votes required).

The recommended budget adjustments detailed below, will increase the Chino Airport Retention and Storm Conveyance III Capital Improvement Program Project No. 09-170 (WBSE 10.10.0007) budget in the amount of $415,212 from $2,304,000 to $2,719,212:

BACKGROUND INFORMATION
The Department of Airports (Airports) manages a system of six airports, including Chino Airport (Airport), on behalf of San Bernardino County (County). The County and the City of Chino (City) are jointly participating in the Kimball Avenue Drainage Improvements Project (Project) to complete improvements to, under, and around Kimball Avenue in the City and to solve drainage issues affecting both the City and County areas surrounding Kimball Avenue. The City will be making storm drain improvements located along a north-south drainage watershed east of Euclid Avenue and within the Chino Preserve Specific Plan (Preserve Specific Plan) area as identified in the City’s Master Plan of Drainage. The Kimball Avenue drainage improvements are included in the Preserve Specific Plan. The improvements will include the construction of a County conveyance structure (Project Component), which will connect with regional drainage structures and facilitate conveyance of storm effluent into a future regional storm water facility. The Project Component includes the County portions of the north and south basins and point of connection to Line H at the south basin.
On April 20, 2021 (Item No. 42), the Board of Supervisors (Board) approved the Cooperative Pass Through Agreement No. 21-276 (Agreement) with the City, in the amount of $801,600, plus $80,160 for project contingencies, for a total amount not to exceed $881,760. The Agreement states that the City is to act as Lead Agency of the Project.
The City received construction bids on May 2, 2023 and presented the lowest responsible and responsive bid packet in the amount of $973,450 to the Department on May 22, 2023. There is an approximate increase of 39% in project costs, largely attributable to the COVID-19 pandemic impacts, such as labor shortages, supply chain issues/delays, and inflation resulting in an increased project cost not to exceed $1,216,812. The revised contract amount includes a 10% construction contingency in the amount of $97,345. All other contingencies provided for in the Agreement would be removed with this recommended Amendment.
