RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of San Bernardino County:
a. Approve Amendment No. 2 to the Memorandum of Understanding No. 25-205 with Southern California Association of Governments, for the Bloomington Sewer Expansion Project, updating the Project Manager for the Southern California Association of Governments, and decreasing the not-to-exceed amount by $2,452,209, from $6,508,000 to $4,055,791, with no change to the term of May 15, 2025 through December 31, 2026.
b. Authorize the Director or Assistant Director of the Department of Public Works to execute Amendment No. 2 to the Memorandum of Understanding with Southern California Association of Governments, subject to review by County Counsel.
c. Direct the Director of the Department of Public Works to transmit executed Amendment No. 2 to the Clerk of the Board of Supervisors within 30 days of execution.
2. Acting as the governing body of County Service Area 70 Zone BL (Bloomington), approve Amendment No. 2 to Construction Contract No. 26-223 with All Cities Engineering, Inc., for the Bloomington Sewer Expansion Project, to address unforeseen utility conflicts that were not reasonably foreseeable at the time of contracting, increasing the total contract amount by $432,820.00, from $2,632,035.60 to $3,064,855.60, and with no change to the contract term of April 9, 2026 through October 9, 2026. FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The grant from Southern California Association of Governments (SCAG), in the amount not-to-exceed $4,055,791, provides funding for the Bloomington Sewer Expansion Project (Project). The grant does not require a local match and will continue to fund eligible design and construction costs. Ineligible project costs, including those not reimbursable under the grant, will be funded by sanitation fees collected for County Service Area 70 Zone BL (District). Sufficient appropriation has been included in the District and the Department of Public Works - Transportation 2026-27 budgets and will be included in future recommended budgets as needed.
BACKGROUND INFORMATION
The Project is located in the unincorporated Bloomington area surrounded by the cities of Rialto and Fontana, and includes installing a sewer mainline on Marygold Avenue, Locust Avenue and Linden Avenue, enabling property owners to transition from septic to sewer. It is estimated that approximately 170 parcels would benefit from this sewer system.
On October 24, 2023 (Item No. 55), the Board of Supervisors (Board) authorized the Department of Public Works - Special Districts (Department) to submit a Regional Utilities Supporting Housing grant application to SCAG for the Project.
On April 8, 2025 (Item No. 62), the Board approved Memorandum of Understanding (MOU) No. 25-205 with SCAG, to provide funding for the Project, in the amount of $6,508,000, for the term of May 15, 2025 through June 30, 2026.
On January 13, 2026 (Item No. 47), the Board approved Amendment No. 1 to MOU No. 25-205 with SCAG, to amend the invoice submittal term from 30 days to 90 days, which provides a mechanism for funding on a cost reimbursement basis, for the Project that the County can meet. The Amendment also extended the MOU term by 185 calendar days, for a full term of May 15, 2025 through December 31, 2026.
Approval of Amendment No. 2 to MOU No. 25-205 with SCAG, will update SCAG’s designated Project Manager and decrease the total grant funding amount, by $2,452,209, from $6,508,000 to $4,055,791, reflecting actual and anticipated expenses needed to complete the Project. In keeping with SCAG’s standard practice, grantees such as the County are required to approve and sign grant agreements prior to SCAG’s final execution.
The Department is requesting the Board to designate the Director or Assistant Director of the Department as the positions with the authority to execute Amendment No. 2. The request is due to SCAG only accepting DocuSign.
On March 24, 2026, (Item No. 55), the Board, acting as the governing body of the District, awarded Contract 26-223 to All Cities Engineering Inc., in the amount of $2,249,535.60, with a construction date of 190 calendar days from the date the Department issued the contractor a Notice to Proceed.
On June 23, 2026, (Item No. 172), the Board approved Amendment No. 1 to Contract No. 26-223 with All Cities Engineering Inc., to add a segment of sewer main to extend the line to Alder Avenue along Marygold Avenue, ensuring continuous service along this corridor rather than terminating midblock, and increased the associated construction contract amount by $382,500, from $2,249,535.60 to $2,632,035.60, with no change to the contract term of April 9, 2026 through October 9, 2026.
During construction, Department staff determined that the proposed sewer main alignment on Linden Avenue conflicted with several existing utilities. A revised Linden Avenue sewer alignment was designed to address the previously unidentified utility conflicts that could not be reasonably anticipated at the time of bid. The revised design requires additional utility coordination, potholing, slurry backfill, and special construction methods.
Approval of Amendment No. 2 to Contract No. 26-223 reflects the associated construction cost adjustments, increasing the total construction contract amount by $432,820.00, from $2,632,035.60 to $3,064,855.60, to address unforeseen utility conflicts encountered during construction, with no other changes to the construction contract or the contract term of April 9, 2026 through October 9, 2026.
