RECOMMENDATION(S)

Recommendation

1.                     Acting as the governing body of San Bernardino County, approve Amendment No. 3 to Memorandum of Understanding No. 15-334 between the Sheriff/Coroner/Public Administrator and County Service Area 70 Countywide, exercising the third and final option to extend the term by one year, for a new total contract period of July 1, 2015 through June 30, 2023, and increasing the compensation amount by $22,215, from $158,470 to $180,685, for continued reimbursement by the Sheriff/Coroner/Public Administrator to County Service Area 70 Countywide for the cost of operating, maintaining and managing the County-owned wastewater collection system at the Glen Helen Rehabilitation Center.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost).  In accordance with this recommended amendment, the Sheriff/Coroner/Public Administrator (Sheriff) shall reimburse County Service Area 70 Countywide (CSA 70) an amount not to exceed $22,215 for the operation, maintenance and management of the County-owned wastewater collection system located at the Glen Helen Rehabilitation Center (GHRC) in 2022-23. This amount reflects no change from the cost of services from the prior fiscal year. Appropriation and revenue pertaining to the continuation of this Memorandum of Understanding (MOU) are included in the 2022-23 budget for the Sheriff and CSA 70.

 

BACKGROUND INFORMATION

GHRC is a detention facility that houses both male and female inmates. The Sheriff is responsible for ensuring that the operation, maintenance, and management of the facility’s wastewater collection system is conducted according to federal, state and local regulatory requirements.  As the Sheriff does not employ certified operators to provide these services, on June 16, 2015 (Item No. 87), the Board of Supervisors (Board) approved MOU No. 15-334 with the Department of Public Works - Special Districts, through CSA 70, to perform wastewater collection system operation, maintenance, and management at GHRC from July 1, 2015 through June 30, 2020 for the not to exceed amount of $114,040. This MOU was subsequently amended as follows:

 

                     On January 5, 2021 (Item No. 50), the Board approved Amendment No. 1 to exercise the first of three one-year options that extended the term for services through June 30, 2021, and increased the compensation amount by $22,215 (from $114,040 to $136,255).

 

                     On May 18, 2021 (Item No. 99), the Board approved Amendment No. 2 to exercise the second of three one-year options that extended the term for services through June 30, 2022, and increased the compensation amount by $22,215 (from $136,255 to $158,470).

 

MOU No. 15-334 allows the term to be extended for three one-year periods through mutual agreement of the parties.  Board approval of this item will exercise the third and final one-year option. This action will extend the term through June 30, 2023, thus permitting CSA 70 to continue to provide service for the Sheriff through staff that has the requisite certifications and experience to ensure public health and safety by meeting all regulatory requirements.
