RECOMMENDATION(S)
Recommendation
1. Find that approval of Amendment No. 1 to Lease Agreement No. 06-1001 with the City of Hesperia for library and office space is an exempt project under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).
2. Approve Amendment No. 1 to Lease Agreement No. 06-1001 with the City of Hesperia to:
a. Extend the term of the Lease Agreement for five years, from October 1, 2026 through September 30, 2031, by exercising the first of two original five-year options to extend, for the County Library’s continued occupancy of approximately 20,102 square feet of library and office space located at 9650 7th Avenue in Hesperia, Assessor’s Parcel Number 0407-271-07-0000.
b. Modify the rental rate structure and update standard lease agreement language as pertains to recital updates set forth in the Amendment.
c. Increase the total lease amount by $5, from $20 to a new total amount of $25.
3. Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).
The total cost of the five-year Lease extension provided by Amendment No. 1 (Amendment) to Lease Agreement No. 06-1001 (Lease) is $5.00, which will be paid in full by the County Library (Library) (6404132600) upon approval and execution of the Amendment. Other costs associated with the Lease include utility and janitorial expenses, which will be paid directly from the Library budget (6404132600). Sufficient appropriation is included in the Library’s 2026-27 recommended budget.

BACKGROUND INFORMATION
Since November 1987, the County has provided library services to the community in the City of Hesperia (City), originally operating from a 4,800 square foot facility located at 9565 7th Avenue in Hesperia. In 2003, the City received a California State Library Grant to construct a new 20,000 square foot library at 9650 7th Avenue in Hesperia (Assessor’s Parcel Number 0407-271-07-0000), which opened on October 14, 2006. The First Supervisorial District contributed an additional $200,000 toward the project. The facility includes study rooms, a community room, a computer lab, and more than 50 public-use computers.
The Lease terms with the City are consistent with similar County-city library agreements. Rent is $1.00 per year, with the County responsible for operational costs, including staffing, materials, utilities, and janitorial services. The City is responsible for facility maintenance and repairs. These obligations are offset by reduced rent, anticipated increases in property tax revenues, and reimbursement from the City for utility costs associated with extended library hours.
On September 26, 2006 (Item No. 28), the Board of Supervisors (Board) approved the Lease with the City for the County's exclusive use of approximately 20,102 square feet of space to provide public library services to the Hesperia community. The Lease commenced on October 1, 2006, at a nominal rental rate of $1.00 per year, reflecting the longstanding partnership between the County and the City to ensure continued access to library services for the community.
The proposed Amendment exercises an existing five-year extension option, extending the term through September 30, 2031, while preserving each party's existing termination rights under the Lease, while updating recital and rent payment timelines. All other terms and conditions remain unchanged. Approval of the Amendment ensures continuity of library services, avoids relocation costs, and represents a fiscally responsible extension under favorable terms.
The project has been reviewed under the California Environmental Quality Act (CEQA) and is exempt pursuant to CEQA Guidelines Section 15301 (Existing Facilities), which applies to the operation and leasing of existing facilities with negligible or no expansion of use.

PROCUREMENT
On September 26, 2006 (Item No. 28), the Board approved the Lease for a 20-year term, procured in accordance with County Policy 12-02 using an alternative procedure. The Policy’s procurement requirements do not apply to amendments of existing leases, provided the total term, including options, is not exceeded.
