Recommendation
Approve Amendment No. 1 to Contract No. 23-636 with Team Legal, Inc., to provide service of process services for court notices under a fee-for-service contract, increasing the contract amount by $550,000, from $825,000 to $1,375,000, updating standard contract language, and extending the contract term for two years, for a total contract period of July 1, 2023 through June 30, 2028.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The total cost of the contract amendment with Team Legal, Inc. (Team Legal) will not exceed $550,000. This is funded through multiple allocations within the Human Services Administrative Claim budget and is supported overall by 85% federal and state funds and 15% local share. Adequate appropriation and revenue have been included in the Human Services Administrative Claim 2026-27 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
Children and Family Services (CFS) are required and obligated to serve parents and dependents with notice of proposed actions by the Juvenile Dependency Court. In these cases, CFS uses a contracted agency to complete the service of process for the required notices. Service of process is the procedure by which a party gives appropriate notice of legal action to another party to respond to the proceeding before the court. Service of process is the personal delivery of the State of California, Superior Court notice(s) to all parents and prospective parents of dependent children that a lawsuit has been initiated against them or there is other pending legal action.
CFS has provided these services through contracted vendors since 1999. During 2024-25, 2,500 service of process requests were completed. In 2025-26, CFS is on track to process approximately 2,400 requests. For 26-2027, CFS anticipates completing an estimated 2,450 service of process requests.
The recommended amendment will allow Team Legal to continue to provide service of process services for these cases. The amendment also updates standard contract language by adding the Levine Act - Campaign Contribution Disclosure (formerly referred to as Senate Bill 1439) provisions.
On June 27, 2023 (Item No. 50), as the result of a formal procurement, the Board of Supervisors approved Contract No. 23-365 with American Eagle Attorney Service, Inc. (American Eagle) and Contract No. 23-636 with Team Legal to provide service of process services for court notices, in the aggregate amount not to exceed $825,000, for the period of July 1, 2023 through June 30, 2026. During the term of the contract, American Eagle terminated its business operations. As a result, Team Legal became the sole provider of service of process services and the aggregate contract amount previously shared between two vendors is now allocated solely to Team Legal.
CFS will review invoices and other documents submitted by Team Legal to ensure the charges are for eligible services prior to payment. The County reserves the right to request additional program and/or fiscal reports to facilitate this monthly review. The contract may be terminated by the County immediately in the event funds are not available and without cause by the County with 30 days' written notice in advance of termination.
Contractor’s performance will be monitored by County staff to ensure compliance with the administrative, program, and fiscal terms and conditions of the contract. Team Legal will cooperate with the County in the monitoring and evaluation of their contract and will comply with any and all reporting requirements established by the contract.
