Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District (SBCFPD):
1. Approve Amendment No. 3 to Revenue Agreement No. 18-354 with the Fontana Fire Protection District, increasing the 2019-20 contract amount by $696,437 (from $30,343,680 to $31,040,117) as compensation to SBCFPD for fire protection and emergency medical services, with all other terms of the contract remaining in effect until June 30, 2038.
2. Authorize the addition of three new positions, as detailed on Attachment A, in accordance with the contract amendment with Fontana Fire Protection District.
3. Approve the reclassification of three existing positions, as detailed on Attachment A, in accordance with the contract amendment with Fontana Fire Protection District.
4. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the appropriation and revenue adjustments to SBCFPD’s 2019-20 budget, as detailed in the Financial Impact section, for the contract amendment with Fontana Fire Protection District (Four votes required).

FINANCIAL IMPACT
Approval of this amendment will not require additional Discretionary General Funding (Net County Cost) as the Fontana Fire Protection District (District) will compensate SBCFPD for the $696,437 increased cost of providing service in 2019-20. This increase is a result of recently approved Memorandums of Understanding (MOU) with various labor unions and the District’s request to add/reclassify certain positions. BACKGROUND INFORMATION
On June 26, 2018 (Item No. 80), the Board of Directors (Board) approved Agreement No. 18-354 for SBCFPD to provide fire protection, prevention, investigations and medical related emergency services to the District. The term of the agreement is for 20 years, ending on June 30, 2038. The compensation amount for providing services is adjusted annually based on various factors.
On June 25, 2019 (Item No. 64), the Board approved Amendment No. 2 to Agreement No. 18-354 that established $30,343,680 as the compensation amount to SBCFPD for services provided in 2019-20. Subsequent to this action, the Board approved new MOU with the following labor unions:
• San Bernardino County Professional Firefighters, IAFF, Local 935, representing employees in the Firefighters Unit - Approved on August 20, 2019 (Item No. 66).
• Association of San Bernardino County Fire Managers, representing employees in the Fire Management Unit - Approved on November 19, 2019 (Item No. 37).
• Sheriff’s Employees’ Benefit Association, representing employees in the Specialized Fire Unit - Approved on January 28, 2020 (Item No. 57).
In addition to the above, the District has requested a change from medic squad to medic engine at Station 77 in Fontana. This change, which is needed to meet service demands, cover assignments, and improve response coverage, results in the addition of three captains and the reclassification of three firefighters to engineers. These position actions will ensure that the proper suppression personnel are assigned to the medic engine.
Approval of Amendment No. 3 will increase the amount of Agreement No. 18-354 by $696,437 in 2019-20 to compensate SBCFPD for the additional costs associated with the aforementioned MOU and the position actions requested by the District. All other terms of the contract shall remain the same.
