RECOMMENDATION(S)

Recommendation

Approve the following amendments to contracts with subrecipients for American Rescue Plan Act funding for eligible projects in accordance with the Board of Supervisors approved Coronavirus Local Fiscal Recovery Fund Spending Plan to modify the deadlines for obligating project costs:

1.                     Amendment No. 1 to Contract No. 22-1239 with the City of San Bernardino, for the Speicher Memorial Park Improvements Project, modifying the deadline for obligating project costs by 38 days, from June 30, 2024 to August 7, 2024, with no change to the cost of $950,000, or the contract term of June 1, 2022 through December 31, 2026.

2.                     Amendment No. 1 to Contract No. 24-1049 with the City of Hesperia, for the Hesperia Traffic Signal Construction Project, modifying the deadline for obligating project costs by 593 days, from December 31, 2024 to August 15, 2026, with no change to the cost of $625,000, or the contract term of July 30, 2024 through December 31, 2026.

3.                     Amendment No. 2 to Contract No. 24-566 with the Monte Vista Water District, for the Monte Vista Powerline Undergrounding Project, modifying the deadline for obligating project costs by 61 days, from February 28, 2026 to April 30, 2026, with no change to the cost of $521,000, or the contract term of May 1, 2024 through December 31, 2026.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). San Bernardino County (County) received a direct allocation of $423.5 million under the American Rescue Plan Act - Coronavirus Local Fiscal Recovery Fund (ARPA Fund) to bolster the County’s response to the Coronavirus (COVID-19) pandemic and its economic impact. The Board of Supervisors (Board) approved an expenditure plan for the use of these funds, known as the County Local Fiscal Recovery Spending Plan (Spending Plan), on June 8, 2021 (Item No. 121)  and amended the plan on August 24, 2021 (Item No. 21). Fifth District is recommending Amendment No. 1 to Contract No. 22-1239, First District is recommending Amendment No. 1 to Contract No. 24-1049, and  Fourth District is recommending Amendment No. 2 to Contract No. 24-566. These items will have no budgetary impact.

 

BACKGROUND INFORMATION

On March 11, 2021, the American Rescue Plan Act (ARPA) was signed into law and established the $350 billion Coronavirus State and Local Fiscal Recovery Fund to distribute resources to state and local governments throughout the nation.

 

The County established an ARPA Team who reviews all potential projects to determine eligibility for ARPA funding and if the project and use is in accordance with the Board approved Spending Plan. When projects are deemed eligible, the ARPA Team works with subrecipients to determine subrecipient compliance with ARPA guidelines and subsequently initiates the contract process.

 

On March 1, 2022 (Item No. 32), the Board authorized the Chief Executive Officer (CEO) to execute the Board-approved standard ARPA contract template with subrecipients and directed that ARPA contracts executed by the CEO be brought back to the Board for ratification within 30 days of contract execution. Monthly reporting has been provided to the Board detailing the status of ARPA contracts.

 

On December 13, 2022 (Item No. 31), the Board ratified the CEO’s exercise of the authority in executing Contract No. 22-1239 on November 14, 2022, with the City of San Bernardino (City). Contract No. 22-1239 pertains to the Speicher Memorial Park Improvements Project (Park Project), with a not-to-exceed amount of $950,000, for the contract term of June 1, 2022 through December 31, 2026.

 

The Speicher Memorial Park Improvements Project involves the enhancement of available recreational spaces and cater to the physical and recreation needs of children in a historically underserved area. The Park Project will involve the renovation of outdoor recreational facilities, installation of a lighting system, and installation of new bleachers.

 

As part of the ARPA Team’s regularly scheduled subrecipient monitoring process, it was discovered that the City could not meet the initial obligation deadline due to unanticipated delays in the design process of the project. These delays led to the City encountering delays in the procurement process. Accordingly, the City is requesting an extension of the obligation deadline from June 30, 2024 to August 7, 2024, to finalize all necessary procurement-related activities. With this extension, the City has met their obligation deadline. All other terms and conditions remain unchanged.

 

On November 5, 2024 (Item No. 17), the Board ratified the CEO’s exercise of the authority in executing Contract No. 24-1049 on October 6, 2024, with the City of Hesperia (Hesperia). Contract No. 24-1049 pertains to the Hesperia Traffic Signal Construction Project (Traffic Project), with a not-to-exceed amount of $625,000, for the contract term of July 30, 2024 through December 31, 2026.

 

The Hesperia Traffic Signal Construction Project will improve safety and traffic movements at this vital intersection within the community to better meet circulation goals. The Traffic Project involves adding a new signal, lighting, and any necessary roadway widening to accommodate turn pockets.

 

As part of the ARPA Team’s regularly scheduled subrecipient monitoring process, it was discovered that Hesperia could not meet the initial obligation deadline due to unanticipated delays in the design process of the Traffic Project. These delays led to Hesperia encountering challenges with the purchase of materials for the construction portion of the project. Accordingly, Hesperia is requesting an extension of the obligation deadline from December 31, 2024 to August 15, 2026, to finalize procurement of materials. All other terms and conditions remain unchanged.

 

On June 25, 2024 (Item No. 51), the Board ratified the CEO’s exercise of the authority in executing Contract No. 24-566 on May 30, 2024, with the Monte Vista Water District (District). Contract No. 24-566 pertains to the Powerline Undergrounding Project (Powerline Project) in the not-to-exceed amount of $521,000, for the contract term of May 1, 2024 through December 31, 2026.

 

On September 23, 2025 (Item No. 43), the Board approved Amendment No. 1 to Contract No. 24-566 to modify the obligation deadline from December 31, 2024 to February 28, 2026, due to significant delays in the design procurement process encountered by the District and had requested an extension of the obligation deadline.

 

The Powerline Project involves managing and coordinating the removal of the Southern California Edison Powerline and telecommunications infrastructure on the District’s property situated at 10575 Central Avenue in Montclair. The Powerline Project includes the construction and installation of 318 linear feet of underground lines to replace the existing overhead infrastructure.

 

As part of the ARPA Team’s regularly scheduled subrecipient monitoring process, it was discovered that the District encountered additional delays in the procurement process. Accordingly, the District is requesting a second extension of the obligation deadline from February 28, 2026 to April 30, 2026, to finalize all necessary procurement-related activities. All other terms and conditions remain unchanged.

 

All of the above projects are anticipated to be completed by December 31, 2026, and are expected to meet the ARPA project expenditure and completion deadlines established by the United States Department of the Treasury.
