RECOMMENDATION(S)
Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District, approve revenue agreements with the following entities for their participation in the Household Hazardous Waste Collection Program from July 1, 2022, through June 30, 2027:
1. Town of Apple Valley in the annual amount of $89,355.29, with inflationary increases ranging from 3.25% to 4.0% per year, for total compensation of $483,994.56.
2. City of Barstow in the annual amount of $22,521.64, with inflationary increases ranging from 3.25% to 4.0% per year, for total compensation of $125,571.89.
3. City of Chino in the annual amount of $106,741.73, with inflationary increases ranging from 3.25% to 4.0% per year, for total compensation of $577,236.55.
4. City of Hesperia in the annual amount of $182,315.06, with inflationary increases ranging from 3.25% to 4.0% per year, for total compensation of $977,738.98.
5. City of Ontario in the annual amount of $319,143.63, with inflationary increases ranging from 3.25% to 4.0% per year, for total compensation of $1,712,082.44.
6. City of Rialto in the annual amount of $140,461.76, with inflationary increases ranging from 3.25% to 4.0% per year, for total compensation of $758,073.95.
7. City of San Bernardino in the annual amount of $317,904.48, with inflationary increases ranging from 3.25% to 4.0% per year, for total compensation of $1,704,892.68.
8. City of Twentynine Palms in the annual amount of $22,413.20, with inflationary increases ranging from 3.25% to 4.0% per year, for total compensation of $120,199.94.
9. City of Yucaipa in the annual amount of $48,875.56, with inflationary increases ranging from 3.25% to 4.0% per year, for total compensation of $262,115.17.
10. Town of Yucca Valley in the annual amount of $33,051.37, with inflationary increases ranging from 3.25% to 4.0% per year, for total compensation of $177,251.47.

FINANCIAL IMPACT
Approval of these revenue agreements will not result in the use of Discretionary General Funding (Net County Cost). These towns/cities will compensate the San Bernardino County Fire Protection District (SBCFPD), Household Hazardous Waste (HHW) Section a total of $6.9 million over the five-year term of the agreements for the cost of their participation in the HHW Collection Program. The following reflects the compensation amount by fiscal year for each city.

For the Town of Apple Valley, City of Barstow, City of Chino, and City of Rialto, the fiscal year amounts above include an annual discount of $13,200 as reimbursement to the Town/City for some of its staffing costs at the HHW facility. The City of Ontario is receiving a similar discount in the amount of $1,500 annually.
Appropriation and revenue related to these agreements are included in SBCFPD’s 2022-23 adopted budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
The California Public Resources Code (Section 47000 et seq.) requires cities and counties to provide household hazardous waste collection programs for the safe collection, recycling, treatment, and disposal of hazardous waste generated by households that should be separated from the solid waste stream. San Bernardino County (County), along with the cities/towns within the County, have developed a countywide cooperative program for the collection and management of household hazardous waste and pharmaceutical waste excluding controlled substances. This program, known as the Household Hazardous Waste Collection Program (HHWCP), is operated by SBCFPD’s HHW Section. SBCFPD contracts with all of the cities and towns within the County, excluding the City of Fontana who operates its own program, for participation in the HHWCP.
Existing agreements with the Town of Apple Valley (Apple Valley), City of Barstow (Barstow), City of Chino (Chino), City of Hesperia (Hesperia), City of Ontario (Ontario), City of Rialto (Rialto), City of San Bernardino (San Bernardino), City of Twentynine Palms (Twentynine Palms), City of Yucaipa (Yucaipa), and Town of Yucca Valley (Yucca Valley) for participation in the HHWCP end on June 30, 2022. Apple Valley, Barstow, Chino, Hesperia, Ontario, Rialto, San Bernardino, Twentynine Palms, Yucaipa, and Yucca Valley desire to continue to protect the welfare of their residents and personnel through the removal of hazardous waste from homes so that the waste will not pose a danger in the event of a fire or other emergency incident. The recommended agreements will allow these cities/towns to continue to participate in the HHWCP through June 30, 2027.
Approval of the recommended agreements will formalize the terms, conditions, and obligations of each party as they relate to participation in the HHWCP. In accordance with these agreements, SBCFPD will be responsible for managing household hazardous waste generated by the residents of Barstow, Chino, Hesperia, Rialto, San Bernardino, Apple Valley, Ontario, Twentynine Palms, Yucaipa, and Yucca Valley. SBCFPD will also be responsible for providing annual waste reports to the applicable public agency.
• For Twentynine Palms, Yucaipa, and Yucca Valley, these cities/towns shall inform their residents of the availability of nearby household hazardous waste collection facilities for safe management of household hazardous waste.
• For Ontario, SBCFPD will operate and staff a HHW collection facility on the city’s property. Ontario will also provide City staff for assistance in accepting household hazardous waste during City run community clean-up days.
• For Hesperia and San Bernardino household hazardous waste will be collected at a designated SBCFPD facility within the City.
• As for Apple Valley, Barstow, Chino, and Rialto, these cities will operate and staff their own HHW collection facility, with SBCFPD providing various services associated with the HHWCP, including the removal of waste and the training of city staff.
