Recommendation
Approve Amendment No. 2 to Participation Agreement No. 24-306 with the California Mental Health Services Authority (State Agreement No. 4634-SHB-2023-SBR) for the State Hospital Program, adding three additional State Hospital beds for a total of 32, increasing the total agreement amount by $44,864, from $152,818 to $197,682, and extending the term an additional year, for the total agreement period of July 1, 2023 through June 30, 2027.

FINANCIAL IMPACT
Approval of this item does not impact Discretionary General Funding (Net County Cost). The increase of $44,864 in the California Mental Health Services Authority (CalMHSA) Participation Agreement (PA) is funded by existing ongoing 1991 Realignment funds. Adequate appropriation and revenue have been included in the Department of Behavioral Health’s (DBH) 2025-26 budget and will be included in the 2026-27 recommended budget.
BACKGROUND INFORMATION
CalMHSA is a Joint Powers Authority (JPA) comprised of California county mental health plans that provides administrative and fiscal services to member counties. The purpose of this collaboration is to maximize resources and support the coordination of statewide or multi-county initiatives, including the State Hospital Program (SHP). DBH has been a member of the CalMHSA JPA since November 2008 and has actively participated in the joint development and funding of mental health services and education programs at both regional and statewide levels.
On behalf of DBH, CalMHSA serves as the primary point of contact and lead negotiator with the California Department of State Hospitals (DSH) for psychiatric bed utilization terms and rates under SHP. To support these services, CalMHSA charges a rate of $1,402 per bed for negotiation and coordination activities. In addition, CalMHSA collaborates with DBH to evaluate and determine the feasibility of local infrastructure projects that may serve as alternatives to State hospital placements, supporting long-term system capacity and improved access to care within the county.
On April 9, 2024 (Item No. 16), the Board of Supervisors (Board) approved PA No. 24-306 with CalMHSA for SHP and Memorandum of Understanding (MOU) No. 24-307 with DSH for the purchase of State Hospital Beds, including non-standard terms, in the amount of $112,160, effective July 1, 2023 through June 30, 2025.
On June 10, 2025 (Item No. 47), the Board approved Amendment No. 1 to PA No. 24-306 with CalMHSA for SHP and MOU No. 25-365 with DSH, including non-standard terms, outlining the services, rates and responsibilities associated with the provision of the 29 State Hospital Beds, increasing the total contract amount by $40,658 , from $112,160 to $152,818, and extending the term by one additional year, for the total contract period of July 1, 2023 through June 30, 2026.
Approval of Amendment No. 2 to the PA will allow DBH to continue receiving support from CalMHSA in identifying and evaluating alternative facilities for psychiatric bed utilization. Additionally, the Amendment adds three hospital beds in the amount of $4,206, in alignment with the Fiscal Year 2026-27 Lanterman-Petris-Short Act (LPS) Bed Allocation plan and ensures the continued administration and negotiation of the 32 state hospital beds allocated to the County through SHP. The LPS Bed Allocation Plan is developed by DSH in collaboration with CalMHSA to promote equitable distribution of LPS beds by accounting for both historical utilization and current population-based need.
