Recommendation
Approve Amendment No. 2 to Employment Contract No. 23-429 with Michael Miller, to continue to provide support services to the Fourth Supervisorial District as a Policy Advisor II, amending the benefits offered to include medical coverage pursuant to the terms and conditions of the Exempt Group Working Conditions Ordinance, effective September 19, 2026, for an estimated annual cost of $168,475 (Salary - $123,011, Benefits - $45,464).

FINANCIAL IMPACT
Approval of the recommendation will not require the use of additional Discretionary General Funding (Net County Cost). Sufficient appropriation exists within the Fourth District’s 2026-27 budget to fund the costs related to the employment contract amendment and will be included in future recommended budgets.
BACKGROUND INFORMATION
Staff services to members of the Board of Supervisors (Board) are provided through contractual arrangements, as required by the County Charter.
On May 23, 2023 (Item No. 5), the Board approved Employment Contract No. 23-429 with Michael Miller to provide services as a Policy Advisor II. On March 24, 2026 (Item No. 11), the Board approved Amendment No. 1 to Employment Contract No. 23-429 to add provisions governing when a new employment contract or amendment is required, amending the term of the contract, and adding Special Assignment Compensation. The recommended amendment to the employment contract will amend the benefits offered and add medical coverage language, effective September 19, 2026, with no other changes to the contract.
Either party may terminate the contract at any time without cause with a 14-day prior written notice to the other party. The contract may be terminated for just cause immediately by the County.
