RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 4 to Contract No. 20-947 with STOP to provide Global Positioning System tracking services for the Probation Department, increasing the contract amount by $500,000, from $3,086,850 to an amount not to exceed $3,586,850, and extending the term for an additional three-month period, for a total contract period of October 1, 2020 through August 31, 2024.

2.                     Approve Amendment No. 4 to Contract No. 20-948 with STOP to provide Global Positioning System tracking services for the Sheriff/Coroner/Public Administrator, with no change to the original contract not to exceed amount of $1,400,834, extending the term for an additional three-month period, for a total contract period of October 1, 2020 through August 31, 2024.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). As a result of Assembly Bill (AB) 1869, which eliminated a county’s ability to charge fees for electronic monitoring and work release programs, the 2022-23 State Budget provided $65,000,000 in revenue to backfill counties for the loss of this fee revenue that supported the programs. The amount allocated to the Probation Department (Probation) for Global Positioning System (GPS) tracking services does not fund the full amount needed. Therefore, additional funding from Probation’s Senate Bill 678 allocation is appropriated to fund the shortfall. Probation has had an increased demand for GPS tracking services due to a continual increase in the number of court orders for high-risk offenders such as Domestic Violence and Sex Offenders, resulting in the need for additional funds. Based on this increase in court orders, there are currently outstanding invoices totaling approximately $100,000 through the end of March. In order to address the outstanding invoices and ensure sufficient funding through the extended term of August 31, 2024, Probation is recommending an increase of $500,000. 

 

The cost of GPS tracking services provided for the Sheriff/Coroner/Public Administrator (Sheriff) is partially funded by AB 109 revenue, and the Department’s existing Discretionary General Fund allocation. Adequate appropriation has been included in each Department’s 2023-24 budgets for the provision of GPS tracking services and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

GPS is a satellite navigation system that allows the user to accurately pinpoint geographic locations. For the past several years, Probation has used GPS tracking services as a supervision tool for a variety of offenders, including gang members and sex offenders. Additionally, Probation uses this technology as a form of house arrest for high-risk juvenile offenders, which reduces the cost to maintain them within the juvenile detention system. The Sheriff uses GPS tracking services to better monitor minimum security inmates and low-risk offenders eligible for placement in a home detention program, in accordance with Penal Code section 1203.016.

 

On September 29, 2020 (Item No. 39), the Board of Supervisors (Board) approved Contract Nos. 20-947 and 20-948 with Satellite Tracking of People, LLC (STOP) for GPS tracking services in an amount not to exceed $900,000 (Probation) and $410,000 (Sheriff) for the period of October 1, 2020 through December 31, 2021, with the option to extend the term for one additional year.

 

On November 16, 2021 (Item No. 41), the Board approved Amendment No. 1 to Contract Nos. 20-947 and 20-948 with STOP for GPS tracking services, for an increase of $900,000, from $900,000 to a total of $1,800,000 (Probation), and an increase of $410,000, from $410,000 to a total of $820,000 (Sheriff), and one-year extension for a total term of October 1, 2020 through December 31, 2022.

 

On December 13, 2022 (Item No. 48), the Board approved Amendment No. 2 to Contract Nos. 20-947 and 20-948 with STOP for GPS tracking services, for an increase of $1,275,000, from $1,800,000 to a total of $2,175,000 (Probation), and an increase of $170,834, from $820,000 to a total of $990,834 (Sheriff), and six-month extension for a total term of January 1, 2023 through May 31, 2023.

 

On May 9, 2023 (Item No. 28), the Board approved Amendment No. 3 to Contract Nos. 20-947 and 20-948 with STOP for GPS tracking services, for an increase of $911,850, from $2,175,000 to a total of $3,086,850 (Probation), and an increase of $410,000, from $990,834 to a total of $1,400,834 (Sheriff), and one-year extension for a total term of June 1, 2023 through May 31, 2024.

 

PROCUREMENT

Probation and Sheriff negotiated the existing contracts for the period of October 1, 2020 through December 31, 2021, based on a competitive procurement process conducted in October 2012 by the National Association of State Procurement Officers (NASPO). The NASPO agreement had an original effective period of May 1, 2013 through December 31, 2021. On July 1, 2021, the NASPO agreement with STOP was extended through May 31, 2024.

 

On February 8, 2024, Request for Proposals (RFP) No. PROB22-PROB-5087 for GPS tracking services was released through the County’s Electronic Procurement Network. Bids were received by the submittal due date on March 8, 2024. The recommended amendments will extend both contracts with STOP through August 31, 2024, to allow Probation and Sheriff to provide uninterrupted GPS tracking services while completing contract negotiations resulting from the aforementioned RFP.
