Recommendation
1. Accept and approve the Homeless Housing, Assistance and Prevention Round 6 Program Grant Agreement (Standard Agreement No. 25-HHAP-10056) with the California Department of Housing and Community Development, on behalf of the CA-609 San Bernardino City and County Continuum of Care and San Bernardino County, including non-standard terms, in the amount of $10,040,923.66, to support regional coordination and to expand or develop local capacity to address immediate homelessness challenges, for the period effective upon execution by the State of California through June 30, 2030.
2. Authorize the Chief Executive Officer, Assistant Executive Officer, Deputy Executive Officer or Chief of Homeless Services to execute the Homeless Housing, Assistance and Prevention Round 6 Program Grant Agreement and any subsequent non-substantive amendments related to the Homeless Housing, Assistance and Prevention Round 6 Program Grant Agreement, on behalf of the CA-609 San Bernardino City and County Continuum of Care and San Bernardino County, subject to review by County Counsel.
3. Direct the Chief of Homeless Services to submit the Homeless Housing, Assistance and Prevention Round 6 Program Grant Agreement and any subsequent non-substantive amendments to the Clerk of the Board of Supervisors within 30 days of execution.
4. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments to the Office of Homeless Services budget, as detailed in the Financial Impact section (Four votes required).

Approval of this item does not result in the use of Discretionary General Funding (Net County Cost). The Homeless Housing, Assistance and Prevention (HHAP) Round 6 allocation totaling $10,040,923.66, with $4,855,338.58 allocated to San Bernardino County (County) and $5,185,585.08 allocated to the CA-609 San Bernardino City and County Continuum of Care (SBC CoC), is funded by the California Department of Housing and Community Development (HCD). No local match is required.

BACKGROUND INFORMATION
The HHAP Program is a block grant project that provides jurisdictions with one-time funding to support regional coordination and expand local capacity to address urgent homelessness challenges. HHAP Round 6 reflects the State of California’s (State) priorities to prevent and quickly reduce unsheltered homelessness. Funding focuses on homelessness prevention activities, sustaining existing interim housing solutions, and permanent housing solutions, including long-term sustainability of affordable permanent supportive housing (Health and Safety Code section 50243(a)).
HHAP Round 6 funds are available to Continuums of Care (CoCs), local or regional planning bodies responsible for addressing homelessness, as well as counties, large cities (with populations of 300,000 or more), and federally recognized tribes. These funds are intended to help individuals and families who are homeless or at risk of homelessness move into and maintain permanent housing.
Eligible uses of HHAP Round 6 funds include, but are not limited to:
• Rapid rehousing and rental subsidies
• Permanent housing solutions, including capital development and operating subsidies
• Interim housing solutions, including navigation centers, non-congregate shelter, and hotel/motel vouchers
• Rental assistance and landlord incentives
• Operating subsidies for interim and permanent housing
• Homelessness prevention and diversion programs
• Street outreach and supportive services
Through OHS, the Administrative Entity (AE) of HHAP funds, the County may enter into contracts with service providers to deliver eligible homeless services upon receipt of funding. OHS is also responsible for ensuring that all funded activities and measurable outcomes align with the County’s Homeless Strategic Plan and the Regionally Coordinated Homelessness Action Plan submitted to the State for both the County and the SBC CoC.
The HHAP Round 6 term begins upon execution by the State and continues through June 30, 2030, with all funds required to be expended by June 30, 2029. Upon full execution of the agreement and satisfaction of applicable State requirements, HCD will provide an initial disbursement of 50 percent of the total award. The remainder will be disbursed after the applicable HHAP Round 6 remainder disbursement requirements are met, including: contractually obligating at least 75 percent and expending at least 50 percent of the initial disbursement by June 30, 2027; submitting, and obtaining approval from HCD for an update to the Regionally Coordinated Homelessness Action Plan by January 31, 2027; and, for the County, maintaining a compliant Housing Element as required by State law. If HCD determines the update or any required corrective action is not satisfactory, it may withhold the remaining funds until the requirements are met. Failure to meet second-disbursement requirements by December 31, 2028, may result in the remaining funds being reallocated in accordance with State requirements. The final year after the expenditure deadline allows for completion of required administrative and closeout processes.
The HHAP Round 6 agreement with the State is non-negotiable and includes the following non-standard terms:
1. The State’s General Terms and Conditions require the County to indemnify, defend, and hold the State harmless in connection with the performance of the agreement.
• The County’s standard contract provisions typically require contractors to indemnify, defend, and hold the County harmless from third-party claims arising from the acts, errors, or omissions of the contractor.
• Potential Impact: If the State is sued for any claim under the County’s use of the grant funds, the County would be responsible for legal defense and any associated costs, expenses, or damages.
2. The agreement allows HCD to terminate the agreement for cause but does not provide the County the ability to terminate for convenience.
• The County standard contract reserves the right to terminate for convenience with 30 days’ notice.
• Potential Impact: The County would not be able to terminate the contract.
On February 11, 2020 (Item No. 26), the Board approved the submission of the HHAP Round 1 Program grant application. On May 19, 2020 (Item No. 36), the Board approved and accepted HHAP Round 1 Program grant funding in the amount of $3,071,060 on behalf of the SBC CoC and $2,845,118 on behalf of the County.
On January 5, 2021 (Item No. 22), the Board approved the submission of the HHAP Round 2 Program grant application. On June 8, 2021 (Item No. 44), the Board accepted HHAP Round 2 Program grant funding in the amount of $1,453,114 on behalf the SBC CoC and $1,300,625 on behalf of the County.
On March 1, 2022 (Item No. 22), the Board authorized the submission of the HHAP Round 3 Initial Disbursement Agreement No. 22-110 in the amount of $780,375 for the SBC CoC. The Board also ratified the Chief Executive Officer’s exercise of authority for the submission of HHAP Round 3 Initial Disbursement Agreement No. 22-111, executed on March 3, 2023, in the amount of $728,350 on behalf of the County.
On June 28, 2022 (Item No. 43), the Board authorized the submission of HHAP Round 3 grant applications for remaining funds following initial disbursement in March 2022 for the SBC CoC in the estimated amount of up to $3,901,875 and for the County in the estimated amount of up to $3,641,750. The final HHAP Round 3 awards totaled $7,543,625 for San Bernardino County and SBC CoC following approval of the remaining disbursement funds by the State.
On November 15, 2022 (Item No. 28), the Board approved and authorized the submission of the HHAP Round 4 grant application. On May 9, 2023 (Item No. 21), the Board approved and accepted HHAP Round 4 grant funding in the amount of $4,430,501 on behalf of the SBC CoC and $4,156,768 on behalf of the County.
On March 12, 2024 (Item No. 19), the Board approved the submission of HHAP Round 5 grant application in the amounts of $6,032,369 for the SBC CoC and $5,787,524 for the County. On March 11, 2025, (Item No. 29) the Board approved the HHAP 5 grant funding in the amount of $6,032,369 allocated to the SBC CoC and $5,787,524 allocated to the County.
On August 19, 2025 (Item No. 34), the Board authorized the submission of HHAP Round 6 grant application in the amounts of $5,185,585.08 for the SBC CoC and $4,855,338.58 for the County.
