RECOMMENDATION(S)

Recommendation

1.                     Accept and approve Amendment No. 3 to Contract No. 21-49 with the California Department of Housing and Community Development, for the Permanent Local Housing Allocation Program, increasing the award by $5,238,444, from $14,752,474 to $19,990,918, with no change to the term of February 2, 2021 through June 30, 2030.

2.                     Adopt Resolution amending Resolution No. 2020-139, as required by the California Department of Housing and Community Development, authorizing the Chair of the Board of Supervisors, Chief Executive Officer, Assistant Executive Officer, Deputy Executive Officer, or Director of the Community Development and Housing Department to execute the Permanent Local Housing Allocation Program documents, including contract documents and amendments, on behalf of San Bernardino County.

3.                     Authorize the Chair of the Board of Supervisors, Chief Executive Officer, Assistant Executive Officer, Deputy Executive Officer, or Director of the Community Development and Housing Department, to approve and sign Permanent Local Housing Allocation Program documents and any subsequent non-substantive amendments, on behalf of the County, subject to review by County Counsel.

4.                     Direct the Director of the Community Development and Housing Department to transmit any subsequent non-substantive amendments related to Contract No. 21-49 to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

This item will not result in the use of additional Discretionary General Funding (Net County Cost). Amendment No. 3 to the Permanent Local Housing Allocation (PLHA) Program contract increases the award by $5,238,444 for allocation years 2022 and 2023, with no change to the contract term of February 2, 2021 through June 30, 2030. The award increase does not require a local match.

 

Adequate appropriation and revenue for the 2022 and 2023 allocations have been included in the Community Development and Housing Department’s (CDH) 2026-27 budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

CDH administers housing and community development programs that expand access to affordable housing, support neighborhood revitalization, and promote long-term housing stability for residents throughout the county. CDH works with public agencies, nonprofit organizations, housing developers, and community stakeholders to identify resources and advance projects that address local housing needs and strengthen communities.

 

This item amends Contract No. 21-49 (State Agreement No. 20-PLHA-15185), with the California Department of Housing and Community Development (HCD) for the PHLA Program. Amendment No. 3 adds San Bernardino County’s (County) 2022 and 2023 formula allocations, increases the total grant award by $5,238,444, from $14,752,474 to $19,990,918, and replaces Exhibits A (Authority, Purpose and Scope of Work) and E (Program-Specific Provisions and Special Conditions) of the Standard Agreement, in their entirety. The 2022 and 2023 formula allocations are the final disbursements for the initial PLHA Program cycle, which covers the years 2019 through 2023.

 

HCD administers PLHA Program formula grants to local governments for housing-related projects and programs. Created by Senate Bill 2, the Building Homes and Jobs Act, the PLHA Program uses revenue collected from prior year real estate transactions to increase the supply of affordable housing statewide. Though estimated allocation amounts are released at the beginning of each five-year PLHA Program funding cycle, the actual annual allocations may be less than the five-year estimate as they are based on real estate transaction revenue collected in prior years.

 

The PLHA Program allows local governments to target funding based on regional needs. The County prioritizes PLHA Program funding to increase the supply of housing for households at or below 80% of the Area Median Income (AMI) depending on the category of eligible uses of funds. The County’s 2022 and 2023 PLHA allocations will be used for the eligible activities listed in the table below.

*Five percent of the 2022 and 2023 allocations will be used to support administrative functions related to the activities identified in the table.

 

Consistent with these efforts, CDH will administer the funds in accordance with the approved PLHA Plan, which is a component of the PLHA Program Application; the Standard Agreement; the applicable Notice of Funding Availability; and all HCD reporting and expenditure requirements. The PLHA allocations must be expended by June 30, 2030.

 

Adoption of the amended Resolution will amend Section 7 of Resolution No. 2020-139 to allow the Chair of the Board of Supervisors (Board), the Chief Executive Officer, the Assistant Executive Officer, the Deputy Executive Officer, or the Director of CDH to execute the PLHA Program Application (Application), the PLHA Standard Agreement and any subsequent amendments or modifications thereto, as well as any other documents that relate to the PLHA Program or the PLHA grant awarded to the County, such as budget modifications and annual reports documenting the uses, expenditures, and outcomes of awarded funds.

 

On July 14, 2020 (Item No. 22), the Board approved the submission of the Application to HCD and adopted Resolution No. 2020-139, certifying that the County was authorized to receive a grant in an amount not to exceed the five-year estimate of $20,754,846. The five-year estimate was derived by multiplying the first-year allocation amount by five (the number of years of annual allocation for the program) and adding a 20% cushion to the cumulative allocation amount.  Resolution No. 2020-139 also delegated authority to the Chair of the Board, Chief Executive Officer, or Director of CDH to execute the Application, PLHA Standard Agreement and any subsequent amendments or modifications to the documents. However, CDH stated the PLHA Standard Agreement would be brought back to the Board for acceptance and execution in accordance with County policy.

 

On January 26, 2021 (Item No. 29), the Board approved Contract No. 21-49 (State Agreement No. 20-PLHA-15185) with HCD, accepting $3,459,141 in PLHA Program funding, for the term of February 2, 2021, through June 30, 2030.

 

On June 14, 2022 (Item No. 22), the Board approved Amendment No. 1 to Contract No. 21-49 with HCD, increasing the award amount by $5,376,577, from $3,459,141 to $8,835,718, with no change to the term of February 2, 2021, through June 30, 2030. The Board also adopted Resolution No. 2022-92 that amended Section 7 of Resolution No. 2020-139 and allowed the Chair of the Board, Chief Executive Officer, Deputy Executive Officer of Community Revitalization, or Director of CDH to execute the Application, the PLHA Standard Agreement and any subsequent amendments or modifications thereto, as well as any other documents that relate to the PLHA Program or the PLHA grant awarded to the County, as HCD may deem appropriate.

 

On July 25, 2023 (Item No. 24), the Board approved Amendment No. 2 to Contract No. 21-49 with HCD, increasing the award by $5,916,756, from $8,835,718 to $14,752,474, with no change to the term of February 2, 2021, through June 30, 2030. The Board also adopted Resolution No. 2023-143, which amended Section 7 of Resolution No. 2020-139, as required by HCD, authorizing the Chair of the Board of Supervisors, Chief Executive Officer, Assistant Executive Officer, or Director of CDH to execute PLHA Program documents, including contract documents and amendments, on behalf of the County.

 

PLHA funds will be allocated to affordable rental housing for households with an income at or below 80% of the AMI. Prior PLHA allocations have funded residential improvements, rehabilitation and property management for the Highland Creek Housing and Wellness Campus development. CDH and the County Administrative Office will continue to evaluate submissions for affordable housing developments that align with and support the County’s Homeless Strategic Action Plan and will return to the Board to recommend future projects.
