RECOMMENDATION(S)

Recommendation

1.                     Adopt Resolution, as required by the United States Department of Housing and Urban Development, authorizing and directing the official authorization and execution of a Cooperation Agreement with the City of Chino, for a request to the United States Department of Housing and Urban Development for Metropolitan City/Urban County Joint Recipient Status.

2.                     Approve the Cooperation Agreement for Housing and Urban Development Community Development and Planning Grants, for Program Years 2027-28, 2028-29, 2029-30, and Subsequent Renewal for Program Years 2030-31, 2031-32 and 2032-33, with the City of Chino, with non-standard terms, for participation in the County’s Urban County Program for the administration of the Community Development Block Grant, HOME Investment Partnerships Act, and Emergency Solutions Grant programs.

3.                     Approve the Community Development Block Grant City-County Delegate Agency Agreement, an exhibit to the Cooperation Agreement, for Housing and Urban Development Community Development and Planning Grants, for Program Years 2027-28, 2028-29, 2029-30, and Subsequent Renewal for Program Years 2030-31, 2031-32 and 2032-33, with the City of Chino, with non-standard terms, for participation in the County’s Urban County Program for the administration of the Community Development Block Grant program.

4.                     Authorize the Chief Executive Officer, Assistant Executive Officer, Deputy Executive Officer of Community Revitalization, or the Director of the Community Development and Housing Department to execute the Cooperation Agreement and the Community Development Block Grant City-County Delegate Agency Agreement with the City of Chino, and any subsequent amendments thereto, and all documents necessary for the implementation and administration of the Cooperation Agreement, the Community Development Block Grant City-County Delegate Agency Agreement, and the grants administered by the Community Planning and Development Division of the United States Department of Housing and Urban Development, subject to review by County Counsel.

5.                     Direct the Director of the Community Development and Housing Department to transmit the Cooperation Agreement and the Community Development Block Grant City-County Delegate Agency Agreement, and any subsequent amendments to the Cooperation Agreement to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

This item will not result in the use of Discretionary General Funding (Net County Cost). The City of Chino’s (City) participation in San Bernardino County’s (County) Urban County Program will be incorporated into the County’s overall federal entitlement allocations from the U.S. Department of Housing and Urban Development (HUD) for Program Years (PY) 2027-28 through 2029-30. Actual allocations for the City will be determined annually based on federal appropriations and HUD allocation formulas. Adequate appropriation and revenue will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The Community Development Block Grant (CDBG), HOME Investment Partnerships Act (HOME), and Emergency Solutions Grant (ESG) programs are federally funded entitlements administered by HUD. These programs provide funding to eligible local governments to support community development activities that benefit low and moderate-income residents. Under Title 24 Part 570.307 of the Code of Federal Regulations, counties must qualify as an “Urban County” to receive these funds and are required to requalify every three years to maintain eligibility. As part of the Urban County structure, participating cities enter into Cooperation Agreements with the County, designating the County as the lead entity responsible for the planning, administration, and implementation of HUD Community Planning and Development programs, including CDBG, HOME, and ESG.

 

The City has requested to participate in the County’s Urban County Program beginning PY 2027-28 through 2029-30. Participation in the Urban County Program creates efficiencies through centralized administration and allows the City to access additional federal resources, including HOME and ESG program funding for which the City may not have independently qualified under HUD eligibility thresholds.

 

The Community Development Block Grant City-County Delegate Agency Agreement (Delegate Agency Agreement), which is an exhibit to the Cooperation Agreement, establishes the framework for the City to implement eligible CDBG-funded activities while ensuring compliance with federal regulations. These agreements include provisions for automatic renewal consistent with federal HUD regulations, allowing for continued participation in subsequent qualification cycles unless terminated by either party in accordance with program requirements. A Delegate Agency Agreement is not required for the implementation of the HOME and ESG grant programs because the County administers these programs on behalf of the participating cities.

 

The Cooperation Agreement and its exhibit, the Delegate Agency Agreement, contain non-standard terms that differ from the standard County contract terms:

1.                     The term commences on July 1, 2027, continues through June 30, 2030, and will automatically renew for one successive three-year Urban County qualification period unless HUD establishes an earlier termination date or either the City or County elects to terminate both agreements at the conclusion of a three-year term. 

                     The County standard contract term is a maximum of five years.

                     Potential Impact: The term of the agreements could be six years. The parties will monitor the term during the re-qualification process with HUD.

2.                     There is no termination for convenience.

                     The County standard contract language gives the County the right to terminate the agreement for any reason with a 30-day written notice of termination.

                     Potential Impact: The County will not have the ability to terminate the agreements for convenience.

3.                     There is mutual indemnification.

                     The County standard contract does not include any indemnification or defense by the County to the other party.

                     Potential Impact: The County will agree to defend and indemnify the City for claims resulting from the negligent acts of the County. In the event that an indemnifiable claim arises, the County would be required to defend the City and potentially pay any settlement/judgment

 

The Resolution is federally required to affirm both the County’s and the City’s intent to participate in the Urban County Program. The Resolution remains in effect for the duration of the Cooperation Agreement and is submitted to HUD as part of the County’s Urban County requalification package.

 

Approval of the Cooperation Agreement and the Delegate Agency Agreement will enable the City to join the County’s Urban County Program for the PY 2027-28 through 2029-30 Urban County qualification period. Under this structure, the County will be the lead administrator, responsible for receiving and managing CDBG, HOME, and ESG funds, allocating resources, and implementing eligible activities while ensuring compliance with HUD requirements, including environmental review and citizen participation. The City will share responsibility for compliance, make funding recommendations, and implement projects in coordination with the County.

 

The City is expected to approve and execute the Cooperation Agreement and the Delegate Agency Agreement in July 2026. Recommendation No. 3 authorizes the Chief Executive Officer, Assistant Executive Officer, Deputy Executive Officer of Community Revitalization, or the Director of the Community Development and Housing Department to execute the Cooperation Agreement and the Delegate Agency Agreement upon receipt from the City, as well as any amendments and related documents required by HUD to complete the Urban County requalification process. Such amendments and related documents may include revisions to agreement terms, regulatory references, certifications, or other compliance documents necessary to maintain Urban County qualification status. Pursuant to HUD's Community Planning and Development Notice CPD-26-08, received on May 19, 2026, CDH will submit the executed agreements to HUD by the August 15, 2026 submission deadline. Delegated authority will facilitate the timely implementation of HUD requirements and allow the County to respond to HUD requests during the review process without delaying submission of the Urban County qualification package.
