RECOMMENDATIONS
Recommendation
1. Approve Addendum No. 1 to the bid documents for the Mojave Splash Pad Reconstruction Project in Victorville, dated April 3, 2026, which revised the bid plans and specifications and responded to the pre-bid requests for information from bidders.
2. Find the bid proposal from Addison-Miller, Inc., to be nonresponsive for failing to submit a signed and complete bid package as required by the bid documents.
3. Find the bid proposal from Three Peaks Corp. to be nonresponsive for failing to hold a state specialty license for Plumbing (C-36) or list a subcontractor with that license, as required by the bid documents.
4. Award Construction Contract, in the amount of $3,585,000, to Dalke & Sons Construction, Inc., for a contract period of 240 calendar days from the date of the issuance of the Notice to Proceed for the Mojave Splash Pad Reconstruction Project in Victorville.
5. Approve a budget increase in the amount of $205,755 to Capital Improvement Program Project No. 23-140, from $4,603,228 to $4,808,983 for the Mojave Splash Pad Reconstruction Project in Victorville, to fund additional improvements required to meet current California Building Code and Americans with Disabilities Act standards, including restroom upgrades, accessible path of travel improvements, utility infrastructure work, and other code required enhancements.
6. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments as detailed in the Financial Impact section (Four votes required).
7. Authorize the Director of the Project and Facilities Management Department to order any necessary changes or additions in the work being performed under the contract referenced in Recommendation No. 4, in the total amount not to exceed $191,750, pursuant to Public Contract Code section 20142.
8. Authorize the Director of the Project and Facilities Management to accept the work when 100% complete and execute and file a Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Costs). The recommended budget increase of $205,755 for the Mojave Splash Pad Reconstruction Project (Project) (WBSE 10.10.1436) will be funded by the Community Service Upgrades Reserve Fund. This increase is necessary to award the construction contract.

BACKGROUND INFORMATION
The existing splash pad at Mojave Narrows Regional Park is antiquated and inadequately sized to accommodate the growth of patronage experienced at Mojave Narrows Regional Park. The existing splash pad does not provide an equity of amenities to the underserved communities in the High Desert Region that residents and visitors of other regions of San Bernardino County enjoy.
On January 10, 2023 (Item No. 43), the Board of Supervisors (Board) approved the Capital Improvement Program (CIP) Project in the amount of $3,300,000.
On February 6, 2024 (Item No. 61), the Board approved a budget increase in the amount of $1,303,228, increasing the total Project budget from $3,300,000 to $4,603,228 to cover the anticipated costs for the additional restroom remodel, parking modifications, and utility infrastructure required for California Building Code (CBC) and Americans with Disabilities Act (ADA) compliance.
On August 6, 2024 (Item No. 30), the Board found the Project to be categorically exempt from under the California Environmental Quality Act Guidelines, Section 15301(e)(1)(2)(A)(B), Class 1, Existing Facilities and Section 15302(b), and Class 2, Replacement of a Commercial Structure. The Board also authorized the Project and Facilities Management Department (PFMD) to advertise for competitive bids for the Project.
On August 9, 2024, PFMD advertised for competitive bids (Request for Proposal No. ANE223-ANE2C-5542) and on September 24, 2024, four bids were received and reviewed by PFMD. All bids exceeded the Project’s construction budget, and on October 21, 2024, PFMD issued formal notices to all bidders that the County was exercising its right to reject all bids.
The Regional Parks Department (Regional Parks) and PFMD met to discuss the plan to value engineer and rebid the Project to reduce anticipated costs to fit within the available budget. PFMD worked with the contracted design team and revised the scope of work to reduce the anticipated construction costs.
Per CBC section 3102B, splash pads are considered ‘public pools’ and are required to meet the same requirements as pools and pool facilities for occupancy calculations and the number of required showers, dressing, and restroom facilities per pool user. The existing bathroom facility does not meet the current ADA requirements nor the current CBC code requirements for bathroom facilities, and requires a remodel to the bathroom facility, upgrades to the utility infrastructure, path of travel to the splash pad, and ADA parking.
On March 2, 2026, in accordance with County Policy 11-15, the Assistant Executive Officer reviewed and approved the updated Project plans and specifications and authorized PFMD to proceed with procurement and advertise for competitive bids.
This Project is consistent with County Administrative Office approved CIP request No. 23-140.
PROCUREMENT
On March 6, 2026, PFMD advertised the Project for competitive bids (Request for Proposal No. ANE223-ANE2C-6342) through the County’s Electronic Procurement Network, the San Bernardino County Sun, and six plan rooms. On March 17, 2026, a mandatory pre-bid conference was held at the Project site in Victorville, and 16 contractors attended.
On April 3, 2026, Addendum No. 1 was issued which revised the plans and specifications and responded to the pre-bid requests for information from bidders.

Addison-Miller, Inc. (AMI) submitted a bid bond but did not submit a bid. AMI was notified of their nonresponsive bid during the bid opening on April 16, 2026, and PFMD recommends the Board find their bid nonresponsive.
One letter of protest was received from Dalke & Sons Construction, Inc., alleging that the apparent low bidder, Three Peaks Corp., did not possess a state issued specialty license for Plumbing (C-36) and failed to identify a subcontractor holding the required license. Following a thorough evaluation of the bid protest and a consultation with County Counsel and the Purchasing Department, PFMD determined that Three Peaks Corp. was nonresponsive of the bid document requirements. Specifically, the bid documents required the contractor to either possess a Plumbing (C-36) license or specify a subcontractor with that license. Three Peaks Corp. does not possess the required license and did not specify a subcontractor with the required license. Three Peaks Corp. was notified by email and certified mail on May 7, 2026, that PFMD would recommend to the Board that their proposal be found nonresponsive. A formal response letter was issued to Dalke & Sons Construction, Inc. on May 7, 2026, informing them that their protest was found valid.
PFMD recommends that the Board award the construction contract to Dalke & Sons Construction, Inc., as the lowest responsive and responsible bidder.
