RECOMMENDATION(S)
Recommendation
1. Approve non-financial Memorandum of Understanding with the Yucaipa-Calimesa Joint Unified School District, including non-standard terms, to provide educational services and activities for students within the district, effective upon execution by all parties through June 30, 2031.
2. Authorize the Chair of the Board of Supervisors, Chief Executive Officer, or Director of the Department of Public Health to execute any subsequent non-substantive amendments to the Memorandum of Understanding with the Yucaipa-Calimesa Joint Unified School District, on behalf of the County, subject to review by County Counsel.
3. Direct the Director of the Department of Public Health to transmit any non-substantive amendments to the Memorandum of Understanding with the Yucaipa-Calimesa Joint Unified School District, to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
This item will not result in the use of Discretionary General Funding (Net County Cost) as the Memorandum of Understanding (MOU) with the Yucaipa-Calimesa Joint Unified School District (School District) is non-financial in nature.
BACKGROUND INFORMATION
The Department of Public Health (DPH) seeks approval to enter into a non-financial MOU with the School District to provide educational services and youth programming at various schools within the district through its Friday Night Live Program (FNL). Under this partnership, DPH will deliver on-campus, youth-led leadership programming facilitated by a DPH Health Education Specialist. Services include regular meetings, evidence-based curriculum, student-driven projects, skill-building workshops, and participation in school and community events. All materials, training, and support will be provided at no cost to the School District.
FNL is a youth-led substance use prevention and leadership development program designed to educate and empower young people to make responsible choices while becoming leaders on their campuses and in their communities. FNL focuses on developing leadership skills among elementary, middle, and high school students and has demonstrated success in addressing a wide range of youth-identified issues.
This MOU includes terms that differ from the standard County Contract and omits certain County standard contract terms. The non-standard and missing terms include the following:
1. The MOU does not require the School District to meet the County’s insurance standards as required pursuant to County Policy 11-07.
• The County Policy requires contractors to carry appropriate insurance at limits and under conditions determined by the County’s Risk Management Department and set forth in the County standard contract.
• Potential Impact: The MOU does not include County standard insurance requirements. This means that the County has no assurance that the School District will be financially responsible for claims that may arise during the course of the MOU.
2. The MOU does not require the School District to indemnify the County for all claims arising out of the MOU.
• The County standard contract indemnity provision requires the Contractor to indemnify, defend, and hold County harmless from third party claims arising out of the acts, errors or omissions of any person.
• Potential Impact: The School District is not required to defend, indemnify or hold the County harmless from claims arising from the County’s own acts or omissions which may arise during the performance of the MOU, which could result in County liability.
DPH recommends approval of the MOU with the School District, including the non-standard terms, to allow DPH and the School District to implement FNL programming across participating school sites.
The MOU will become effective upon execution by all parties through June 30, 2031.
