RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 1 to non-financial Facility Access Agreement No. 25-276, with California Department of Health Care Services, to allow the California Department of Health Care Services access to facilities operating within the Behavioral Health Bridge Housing Program grant, updating the agreement name, and revising property addresses within Attachment A, with no change to the term of May 19, 2025 through June 30, 2027.

2.                     Authorize the Chair of the Board of Supervisors, Chief Executive Officer, Assistant Executive Officer, Deputy Executive Officer, or the Director of the Department of Behavioral Health, to execute and submit Amendment No. 1 and any subsequent non-substantive amendments to the Facility Access Agreement, for the Behavioral Health Bridge Housing Program, as required by California Department of Health Care Services, subject to review by County Counsel.

3.                     Direct the Director of the Department of Behavioral Health to transmit Amendment No. 1 and any subsequent non-substantive amendments, related to the Facility Access Agreement, to the Clerk of the Board of Supervisors within 30 days of execution.

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as this amendment is non-financial in nature.

 

BACKGROUND INFORMATION

The California Department of Health Care Services (DHCS) Behavioral Bridge Housing (BHBH) Program, established through Assembly Bill 179 in September 2022, was created to support and enhance statewide investments aimed at addressing homelessness, including Project Homekey, Community Care Expansion, and the Behavioral Health Continuum Infrastructure Program. The BHBH Program focuses primarily on funding operations and supportive services that expand bridge housing opportunities. Its central goal is to assist individuals experiencing homelessness who are living with severe mental illness (SMI) and/or substance use disorders (SUD), which may create barriers to accessing services and obtaining stable housing.

 

The Department of Behavioral Health (DBH) uses BHBH Program grant funding to operate a variety of bridge housing programs, including Emergency Shelter Services, Recovery Residences, and hotel/motel bridge housing programs to address the immediate and long-term housing needs of individuals experiencing homelessness who have SMI and/or SUD. The Emergency Shelter Services program provides temporary housing solutions for individuals experiencing SMI and homelessness while they collaborate with DBH staff to develop and implement long-term housing plans. The Recovery Residences program supports individuals participating in treatment services as they progress through their recovery journey. The hotel/motel beds program is for individuals with SMI and/or SUD who are able to live independently while waiting for a treatment bed to become available. As individuals work toward permanent housing goals, DBH staff assist them in identifying available housing opportunities and supportive resources.

 

On April 25, 2023 (Item No. 21), the Board of Supervisors (Board) approved DBH to submit the BHBH Program grant application to DHCS, in the amount of $27,375,170, for the anticipated period of July 1, 2023 through June 30, 2027.

 

On December 5, 2023 (Item No. 21), the Board approved Subcontractor Agreement No. 23-1285 (Subcontractor Agreement), including non-standard terms, with Advocates for Human Potential, Inc., on behalf of DHCS for the BHBH Program grant award, to address the immediate and sustainable housing needs of individuals experiencing homelessness who have SMI and/or SUD, in the amount of $27,375,170, for the period of June 23, 2023 through June 30, 2027.

 

On March 25, 2025 (Item No. 18), the Board approved Amendment No. 1 to the Subcontractor Agreement, which adjusted the allocated implementation and infrastructure reimbursement from 25% of total grant funds to a fixed amount of $1,443,500. In addition to the change in project implementation and infrastructure funding, the cost of furnishings, appliances, and equipment are now included in reimbursable costs. Start up and infrastructure projects’ disbursement of funds have been added to the payment schedule to include specific invoice guidelines.

 

On May 6, 2025, (Item No. 13), the Board approved the non-financial Access Agreement No. 25-276 as a required separate agreement, which mandates the BHBH Subcontractor access to operating facilities in relation to the Subcontractor Agreement for the term of May 19, 2025 through June 30, 2027.

 

DBH staff were notified in April 2026, by Advocates for Human Potential, Inc., the third party administrator on behalf of DHCS, of the need to amend the Access Agreement name and revise Attachment A. Approval of this item will amend the agreement name from Access Agreement to Facility Access Agreement and revise Attachment A to reflect the addresses of the locations receiving infrastructure funding.

 

DBH also requests delegated authority to execute and submit any non-substantive amendments to the Facility Access Agreement to ensure executed documents are returned in a timely manner as required by the state.
