Recommendation
1. Acting as the governing body of San Bernardino County, approve Amendment No. 3 to Memorandum of Understanding No. 15-336 between the Sheriff/Coroner/Public Administrator and County Service Area 70 Countywide, exercising the third and final option to extend the term by one year, for a total contract period of July 1, 2015 through June 30, 2023, and increasing the compensation amount by $521,798, from $3,381,850 to $3,903,648, for continued reimbursement by the Sheriff/Coroner/Public Administrator to County Service Area 70 Countywide for the cost of operating, maintaining and managing the County-owned water distribution and water treatment systems at the High Desert Detention Center.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). In accordance with this recommended amendment, the Sheriff/Coroner/Public Administrator (Sheriff) shall reimburse County Service Area 70 Countywide (CSA 70) an amount not to exceed $521,798 for the operation, maintenance and management of the County-owned water distribution and water treatment systems located at the High Desert Detention Center (HDDC) in fiscal year 2022-23. This amount reflects a three percent increase from prior year. Appropriation and revenue pertaining to the continuation of this Memorandum of Understanding (MOU) were included in the 2022-23 budget for the Sheriff and CSA 70.
BACKGROUND INFORMATION
In January 2006, the HDDC in Adelanto was added as the fourth detention facility in the County’s Bureau of Corrections. HDDC became the first facility of its size to serve the County’s High Desert region. As part of construction of this facility, a water well, reverse osmosis water treatment unit, large reservoir and associated appurtenances were designed and constructed on site.
The Sheriff is responsible for ensuring that the operation, maintenance, and management of the water distribution and water treatment systems at the HDDC are conducted according to federal, state and local regulatory requirements. As the Sheriff does not employ State Water Resources Control Board-certified water distribution and water treatment operators to provide these services, on June 16, 2015 (Item No. 90), the Board of Supervisors (Board) approved MOU No. 15-366 with the Special Districts Department, through CSA 70, to perform systems operation, maintenance, and management at HDDC from July 1, 2015 through June 30, 2020. This MOU was subsequently amended as follows:
• On January 5, 2021 (Item No. 49), the Board approved Amendment No. 1 to exercise the first of three one-year options that extended the term for services through June 30, 2021.
• On May 18, 2021 (Item No. 100), the Board approved Amendment No. 2 to exercise the second of three one-year options that extended the term for services through June 30, 2022.
MOU No. 15-366 allows the term to be extended for three one-year periods through mutual agreement of the parties. Board approval of this item will exercise the third and final one-year option. This action will extend the term through June 30, 2023, thus permitting CSA 70 to continue to provide service for the Sheriff through staff that has the requisite certifications and experience to ensure public health and safety by meeting all regulatory requirements.
