RECOMMENDATION(S)
Recommendation
1. Approve non-financial General Data Use and Disclosure Agreement, which includes the CalCONNECT Cross-Jurisdictional Data Sharing Authorization - Exhibit G, with the California Department of Public Health, including non-standard terms, to access the Center for Infectious Diseases General Data System, effective for a period of three years after the latest signature date.
2. Authorize the Health Officer for San Bernardino County to execute and submit the General Data Use and Disclosure Agreement, CalCONNECT Cross-Jurisdictional Data Sharing Authorization - Exhibit G, and any subsequent non-substantive amendments, as required by the California Department of Public Health, subject to review by County Counsel.
3. Direct the Health Officer or the Director of the Department of Public Health to transmit the General Data Use and Disclosure Agreement and any non-substantive amendments to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the recommended Data Use and Disclosure Agreement with the California Department of Public Health (CDPH) is non-financial in nature.
BACKGROUND INFORMATION
The Center for Infectious Diseases General (CIDG) Data Use and Disclosure Agreement (Agreement) with CDPH authorizes local health jurisdictions to access and use the CIDG Data system for public health purposes, while establishing strict privacy, security, and compliance requirements.
Historically, CDPH maintained separate agreements for multiple systems supporting statewide reporting and disease-surveillance activities for conditions such as Covid-19, tuberculosis, mpox, sexual transmitted diseases, and human immunodeficiency virus, among other activities and reporting. CDPH has now consolidated these systems under a single universal agreement that serves as an umbrella for all related databases, including California Immunization Registry, California Reportable Disease Information Exchange, and California Connect, Integrated Infectious Disease Data Warehouse, and My Turn Vaccine Management System.
Approval of the recommended non-financial Agreement will be in effect for a period of three years from execution of all parties. The Agreement defines information, privacy and security requirements with respect to all data collected or created, transmitted, received, or downloaded in the CIDG Data system. These databases are intended to improve the efficiency of disease surveillance and response activities and to strengthen early detection of public-health events through the collection of more complete and timely surveillance information on a state-wide basis.
Recommendation No. 2 allows the Health Officer to execute and submit both the Agreement and CalCONNECT Cross-Jurisdictional Data Sharing Authorization form, as required by CDPH, to ensure access to state databases and participation in the cross-jurisdictional data sharing related to contagious, infectious, communicable and reportable diseases and conditions.
This non-financial Agreement includes terms and conditions that differ from the standard County contract and omits certain contract terms. The non-standard terms include:
1. The Agreement does not require CDPH to indemnify the County for all claims arising out of the agreement.
• The County standard contract indemnity provision requires the Contractor to indemnify, defend, and hold County harmless from third party claims arising out of the acts, errors or omissions of any person.
• Potential Impact: CDPH is not required to defend, indemnify or hold the County harmless from claims arising from the County’s own acts or omissions which may arise during the performance of the agreement. Additionally, if the County is sued for any claim based on its use of CDPH services, the County may be solely liable for the costs of defense and damages, which could exceed the total agreement amount.
2. The Agreement does not require CDPH to meet the County’s insurance standards as required pursuant to County Policy 11-07.
• The County Policy requires contractors to carry appropriate insurance at limits and under conditions determined by the County’s Risk Management Department and set forth in the County standard contract.
• Potential Impact: The Agreement does not include County standard insurance requirements. This means that the County has limited assurance that CDPH will be financially responsible for claims that may arise during the course of the agreement.
DPH recommends approval of the Agreement, including the non-standard terms, as approval of this item will allow DPH to access multiple databases used to collect information on reportable diseases and to support the San Bernardino County’s response to health outbreaks in the county.
