RECOMMENDATION(S)
Recommendation
1. Approve non-financial Memorandum of Understanding with the San Bernardino City Unified School District, including non-standard terms, for the San Bernardino County Department of Public Health to provide mobile dental and immunization services to students, for the period of July 1, 2026 through December 31, 2027.
2. Authorize the Chair of the Board of Supervisors, Chief Executive Officer, or Director of the Department of Public Health to execute any subsequent non-substantive amendments to the Memorandum of Understanding with San Bernardino City Unified School District, on behalf of the County, subject to review by County Counsel.
3. Direct the Director of the Department of Public Health to transmit any non-substantive amendments to the Memorandum of Understanding with the San Bernardino City Unified School District to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
This item will not result in the use of Discretionary General Funding (Net County Cost) as the Memorandum of Understanding (MOU) with the San Bernardino City Unified School District (SBCUSD) is non-financial in nature.
BACKGROUND INFORMATION
DPH provides low-cost health services through Federally Qualified Health Centers and public health clinics located throughout the county. In addition, DPH is increasing access to health services through its deployment of mobile clinics. The mobile clinics are equipped to deliver dental services and provide support for school-based vaccination clinics.
Approval of this item would allow DPH to enter into an MOU with SBCUSD to provide mobile dental and immunization services. Under the terms of the MOU, DPH will provide SBCUSD students with on-site dental services, including basic screenings and assessments, application of topical fluoride varnish, emergency dental services, preventative care and oral health education, comprehensive examinations with X-rays, oral prophylaxis, periodontal scaling and root planning, sealant, fillings, and oral hygiene instructions. Mobile immunization services include eligibility screening, administering of all age-appropriate Advisory Committee on Immunization Practices-recommended vaccines, documentation of all administered vaccines in the California Immunization Registry, issuing patients proof of vaccination, and recommending non-routine vaccines when indicated or when requested.
The MOU includes terms that differ from the standard County Contract and omits certain County standard contract terms. The non-standard and missing terms include the following:
1. The MOU does not adhere to the County’s insurance standards as required pursuant to County Policy 11-07.
• The County Policy requires partner agencies to carry appropriate insurance at limits and under conditions determined by the County’s Risk Management Department.
• Potential Impact: The MOU does not include County standard insurance requirements. The County has no assurance that SBCUSD will be financially responsible for claims that may arise under the MOU, which could result in expenses to the County.
2. The County is required to indemnify SBCUSD against claims and losses.
• The County standard contract does not include any indemnification or defense by the County of a contractor.
• Potential Impact: By agreeing to mutual indemnification, the County could be contractually waiving the protection of sovereign immunity. Claims that may otherwise be barred against the County, time limited, or expense limited could be brought against SBCUSD without such limitations and the County could be responsible to defend and reimburse SBCUSD for costs, expenses, and damages.
DPH recommends approval of the MOU, including non-standard terms, to allow students of SBCUSD to receive vital dental and immunization services that they might not otherwise receive due to inability to pay.
