RECOMMENDATION(S)
Recommendation
Acting as the governing body of Board Governed County Service Area 70, conduct a public hearing to:
1. Declare the results of the property owner election held on January 24, 2020 to form County Service Area 70, Zone R-49 (Fawnskin) for the provision of road paving, maintenance and snow removal services.
2. Adopt resolution:
a. Approving the formation of County Service Area 70, Zone R-49 (Fawnskin) in the unincorporated Big Bear area for road paving, maintenance and snow removal services.
b. Establishing an annual per parcel service charge of $1,181.02 on real property within the boundaries of County Service Area 70, Zone R-49 (Fawnskin), which includes a fixed amount of $700.76 for ten years to repay a loan for an initial road paving project and $480.26, subject to an annual inflationary increase of up to 3%, for ongoing operation, maintenance and snow removal services.
c. Directing the Clerk of the Board of Supervisors to proceed with various actions in regards to the formation of County Service Area 70, Zone R-49 (Fawnskin) including filing copies of the resolution and related boundary map with the County Assessor and State Board of Equalization.
3. Authorize the Auditor-Controller/Treasurer/Tax Collector’s office to place the above annual service charge on the tax roll beginning in 2020-21 to fund road paving, maintenance and snow removal charges and administrative costs for County Service Area 70, Zone R-49 (Fawnskin).
4. Authorize the Auditor-Controller/Treasurer/Tax Collector to post 2019-20 budget adjustments in the amount of $125,529, as indicated in the Financial Impact section, for a County Service Area 70, Zone R-49 (Fawnskin) road paving capital improvement project (Four votes required).

Approval of this item will not result in the use of Discretionary General Fund (Net County Cost).
On December 10, 2019 (Item No. 54), the Board of Supervisors (Board) approved a loan from the County Service Area Revolving Loan Fund in the amount of $125,529.68 for an initial road paving project within County Service Area 70, Zone 49 (CSA 70, R-49). The loan was contingent upon a successful election to form CSA 70, R-49.
With the successful election, an annual service charge of $1,181.02 per parcel will be assessed on properties within CSA 70, R-49 beginning in 2020-21. This service charge includes a fixed amount of $700.76 for ten years to repay the $125,529.68 loan, along with accrued interest as determined by the County Treasurer, and $480.26, subject to an annual inflationary increase of up to 3%, for ongoing road paving, maintenance and snow removal service charges, as well as related administrative costs. The service charge will be billed on 21 parcels within the new district.
This item also authorizes the Auditor-Controller/Treasurer/Tax Collector to post the following adjustments to the 2019-20 budget for the CSA 70, R-49 loan and initial road paving project:

BACKGROUND INFORMATION
The Special Districts Department (Department) was contacted by residents in the neighborhood
of Seminole Drive, Fawnskin, in the unincorporated area of Big Bear regarding the possibility of forming a new road district. The new district would provide road services that include paving, maintenance, and snow removal on Seminole Drive from Highway 38 to the end of the dirt road section.
On December 10, 2019 (Item No. 54), the Board approved an action authorizing the Department to conduct a mailed ballot election of property owners within the proposed new district for an annual service charge of $1,181.02 per parcel. Each of the 21 parcels within the district would be assessed $700.76 for the first 10 years to repay a $125,529.68 loan, with interest, for a road paving project. In addition, an amount of $480.26, with an annual inflationary increase of up to 3%, would be assessed annually for ongoing road paving, maintenance and snow removal service charges and administrative costs. To proceed with this service charge, a simple majority (50%, plus one) of the ballots returned from the property owners would need to be in favor of the proposed district.
The ballots were mailed by an independent election provider on December 11, 2019 and were received by January 24, 2020 (January 24, 2020 serves as the official election date). The results of the mailed ballot proceeding determined that 57.14% of the property owners who returned their ballots voted in favor of the proposed district. Therefore, the Department recommends approval of this item to form CSA 70, R-49 and establish an annual service charge on parcels within the district. The service charge will be placed on the tax roll beginning in 2020-21.
With formation of CSA 70, R-49 and establishment of the annual per parcel service charge, the Department will ensure that annual road paving, maintenance and snow removal service maintenance is performed beginning in 2020-21.
