Recommendation
Approve Amendment No. 4 to Contract No. 18-741 with Forensic Logic, LLC., to incorporate required language related to the federal Byrd Anti-Lobbying Amendment Clause and Certification per 31 United States Code 1352 (45 Code of Federal Regulations 2543.87), with no change to the contract amount of $852,342 or the contract period of November 1, 2018, through March 31, 2023.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The current annual cost of the contract between the Sheriff/Coroner/Public Administrator (Department) and Forensic Logic, LLC for annual maintenance of the COPLINK software system is $184,171, which is funded through the United States Department of Homeland Security Grant Program’s (HSGP) Fiscal Year 2020 award.
BACKGROUND INFORMATION
On September 25, 2018 (Item No. 47), the Board of Supervisors (Board) approved Contract No. 18-741 with Forensic Logic, LLC (Forensic Logic) to provide software development and proprietary maintenance and technical support of the COPLINK system in the amount of $250,791 for the period of November 1, 2018 through October 31, 2019. This system provides the Department with cross-jurisdictional information sharing and analysis over a highly secure web-based platform. Subsequently, the Board approved three amendments to Contract No. 18-741, with the most recent being Amendment No. 3 (March 1, 2022, Item No. 55), that ultimately extended the term through March 31, 2023 and increased the amount to $852,342.
Non-Federal Entities who intend to award contracts of more than $100,000 are required to include on all sub-awards, subcontracts, sub-grants, and contracts a provision that references the Byrd Anti-Lobbying Amendment Clause and Certification (Title 31 U.S.C. § 1352), which prohibits the use of federally appropriated funds to influence officers or employees of the Federal Government. The contract with Forensic Logic is funded through HSGP. At the time of processing Contract No. 18-741 and subsequent renewals, the required anti-lobbying provision was not included in the documentation.
Approval of this item will incorporate the Byrd Anti-Lobbying Amendment clause and certification to the contract with Forensic Logic.
