RECOMMENDATION(S)
Recommendation
1. Approve Amendment No. 3 to Revenue Agreement No. 23-186, which includes Schedule B-2, with the Southern California Regional Rail Authority - Metrolink, for the Sheriff/Coroner/Public Administrator to provide law enforcement services for the Metrolink Passenger Rail Lines, increasing the contract amount by $6,375,915, from $11,788,726 to $18,164,641, and exercising the second option to extend the term by one year, for a new total contract period of March 15, 2023 through June 30, 2027.
2. Authorize the Sheriff/Coroner/Public Administrator or Undersheriff to revise and execute any non-substantive amendments to Schedule B-2 with the Southern California Regional Rail Authority - Metrolink, to update the cost of service based on the Board of Supervisors’ action related to changes in employee salary and benefits cost or service level changes requested by the Southern California Regional Rail Authority - Metrolink in 2026-27, subject to review by County Counsel.
3. Direct the Sheriff/Coroner/Public Administrator to transmit any non-substantive amendments to Schedule B-2 to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The proposed Amendment No. 3 (Amendment) to Revenue Agreement No. 23-186 (Agreement) provides revenue in the estimated amount of $6,375,915, which includes recovery of both direct and indirect costs for the Sheriff/Coroner/Public Administrator (Department), to provide law enforcement services for the Southern California Regional Rail Authority - Metrolink (SCRRA - Metrolink), operator of the Metrolink Passenger Rail Lines in San Bernardino County. Sufficient appropriation and revenue are included in the Department’s 2026-27 budget.
BACKGROUND INFORMATION
The San Bernardino County Transit Authority (SBCTA), in conjunction with SCRRA - Metrolink, developed and operate the Arrow Line, a nine-mile commuter route with five stations that connects residents, businesses, and visitors to a variety of leisure, education, healthcare, and other destinations in the area. The stations include San Bernardino - Downtown Station located at Rialto Avenue and E Street, San Bernardino - Tippecanoe Station located between Victoria Avenue and Hardt Street; Redlands - Esri Station across from the Esri campus; Redlands - Downtown Station just north of the historic Redlands Santa Fe Depot; and Redlands - University Station, located at the south end of the campus.
On December 13, 2022 (Item No. 76), the Board of Supervisors (Board) approved Revenue Agreement No. 22-1233 with SBCTA to provide law enforcement services for the Arrow Line, retroactively from October 24, 2022 through November 30, 2022, for an amount of $100,000. On the same action, the Board approved Amendment Nos. 1 and 2 to Agreement No. 22-1233, increasing the estimated revenue amount by $522,408, from $100,000 to $622,408, extending the term through January 31, 2023, and delegating authority to the Chief Executive Officer to execute additional amendments to the agreement with SBCTA, which included extension of the performance period for up to three additional months and additional revenue. Under that authority, two additional amendments were executed, increasing the estimated revenue amount to $750,779 and extending the term through March 14, 2023.
On March 14, 2023 (Item No. 55), the Board approved the Agreement with SCRRA - Metrolink to provide continued, uninterrupted law enforcement services for the Arrow Line on a long-term basis, effective March 15, 2023 through June 30, 2025, including annual review of the Agreement’s Schedule B - Cost Schedule (Schedule B), which reflected the cost of service at the time, and estimates for 2023-24 and 2024-25, in an amount of $5,656,205, to ensure proper cost recovery by the County. In the same action, the Board authorized the Sheriff/Coroner/Public Administrator (Sheriff) or Undersheriff to revise and execute amendments to Schedule B. No amendments to the Agreement were needed, as the estimated costs listed were lower than the Department’s actual costs to provide the service during 2023-24 and 2024-25.
On June 18, 2025 (Item No. 100), the Board approved Amendment No. 1 to the Agreement with SCRRA - Metrolink, increasing the estimated revenue amount by $5,689,094, from $5,656,205 to $11,345,299, and exercising the first option to extend the term by one year, for a new contract period of March 15, 2023 through June 30, 2026, with the option to extend by one additional one-year period; and authorized the Sheriff or Undersheriff to revise and execute any non-substantive amendments to Schedule B-1 with SCRRA - Metrolink to update the cost of service based on the Board’s action related to employee salary and benefits costs for 2025-26. On the same action, the Board authorized the addition of 10 new regular positions to the Agreement. The increase in cost and positions to the Agreement were the result of SCRRA - Metrolink request to extend the area of coverage to include Metrolink’s passenger lines that traverse through San Bernardino County up to the geographical boundaries of Los Angeles and Riverside counties effective July 1, 2025.
On September 9, 2025 (Item No. 36), the Board approved changes and increases to safety employees’ salaries and benefits that became effective October 4, 2025. Based on that Board action, and after approval by SCRRA - Metrolink’s administration, on July 22, 2026, the Sheriff, under the Board-approved delegated authority to revise and execute any non-substantive amendments to Schedule B-1, executed Amendment No. 2 to update the cost of service increasing the Agreement’s amount by $443,427, from $11,345,299 to $11,788,726, with no changes to the Agreement’s period of March 15, 2023 through June 30, 2026, following County Counsel review.
This Agreement is beneficial to both SCRRA - Metrolink and the County because having a dedicated law enforcement presence increases public safety on the Metrolink’s passenger lines throughout the county. Amendment No. 3 was provided to SCRRA - Metrolink on May 6, 2026, for their approval, but due to unforeseen circumstances, the signed documents were not received by the Department until July 1, 2026. The request for approval is being submitted to the Board at the earliest available meeting. Approval of the proposed Amendment will approve the changes to the cost of the Agreement with SCRRA - Metrolink and extend the period of service through June 30, 2027. In the event of a service level reduction to the Agreement, incumbent staff will be reassigned to existing vacant positions within the Department, in accordance with existing procedures. The Agreement provides for termination by either party upon 90 days’ advanced notice.
