RECOMMENDATION(S)

Recommendation

Acting as the governing body of County Service Area 70 D-1:

1.                     Find that approval of Amendment No. 1 to Revenue License Agreement No. 20-354 with Arrowhead Arts Association, Inc., for non-exclusive access to County Service Area 70 D-1 land, is exempt under the California Environmental Quality Act Guidelines, Section 15301 - Existing Facilities (Class 1).

2.                     Approve Amendment No. 1 to Revenue License Agreement No. 20-354 with Arrowhead Arts Association, Inc, for non-exclusive use of County Service Area 70 D-1 land located at 29419 Torrey Road (Assessor’s Parcel Number 0330-011-38-0000), in Lake Arrowhead, for storage purposes, to:

a.                     Extend the term of the agreement for five years, from June 2, 2026 through June 1, 2031.

b.                     Approve a 12-month permitted holdover period from June 2, 2025 through June 1, 2026 in the amount of $1,008.

c.                     Approve additional revenue in the amount of $4,728, which includes $1,008 for the permitted holdover period of June 2, 2025 through June 1, 2026, and $3,720 for the first extended term.

d.                     Increase the total contract amount from $3,000 to $7,728.

3.                     Direct the Real Estate Services Department to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  The total anticipated revenue associated with Amendment No. 1 (Amendment) for Revenue License Agreement No. 20-354 (License) is $4,728, which includes $1,008 for the permitted holdover period and $3,720 for the extended term.  Revenue will be received by County Service Area (CSA) 70 D-1 (1300001408).  Total revenue is as follows:

BACKGROUND INFORMATION

Arrowhead Arts Association (Arrowhead Arts) is a public service organization composed of local Lake Arrowhead residents dedicated to preserving and supporting the artist community in the Lake Arrowhead area.  CSA 70 D-1 owns a storage lot adjacent to Papoose Lake at 29419 Torrey Road.  Arrowhead Arts requested permission from CSA 70 D-1 to store a trailer containing equipment used in public service activities on a portion of CSA 70 D-1 owned parcel.  CSA 70 D-1 requested that the Real Estate Services Department (RESD) prepare a license agreement for the use of the space.

 

On June 2, 2020 (Item No. 43), the Board of Supervisors (Board) approved the License with Arrowhead Arts for five years from June 2, 2020 through June 1, 2025, for approximately 750 square feet of land for exterior space located at 29419 Torrey Road in Lake Arrowhead.

 

The lease entered a permitted month-to-month holdover beginning June 2, 2025 through June 1, 2026, due to timing associated with negotiations and administrative processing.  Following the permitted holdover, Arrowhead Arts agreed to extend the term for 5 years from June 2, 2026 through June 1, 2031.  All other License terms remain unchanged.

 

The project to approve the Amendment was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under Section 15301 - Class 1 Existing Facilities because the proposed Amendment involves continued use of existing facilities with negligible or no expansion of the existing use.  Accordingly, no further action is required under CEQA.
