Recommendation

1.                     Acting as the governing body of the San Bernardino County Fire Protection District, approve agreements between San Bernardino County, San Bernardino County Fire Protection District, and the listed contractors to assign to San Bernardino County Fire Protection District, and amend the following on-call fire abatement services contracts, effective July 1, 2026, to increase the total not-to-exceed amount by $750,000, from $2,550,000 to $3,300,000, and extend the term by one year, for a total contract period of September 1, 2022, through August 31, 2027:

a.                     Alex Bohanek dba A.B. Landscape, Amendment No. 3 to Contract No. 22-744

b.                     Sustainable Mitigation, Amendment No. 3 to Contract No. 22-745

c.                     C & M Weed Abatement, Amendment No. 3 to Contract No. 22-746

d.                     AD Improvements, Inc., Amendment No. 3 to Contract No. 23-1294

FINANCIAL IMPACT

Approval of the recommended actions will not result in the use of additional Discretionary General Funding (Net County Cost). Approval of this item will assign and novate the existing Agreements from San Bernardino County (County), through its Land Use Services Department (LUS), to the San Bernardino County Fire Protection District (SBCFPD).  Additionally, the total not-to-exceed amounts for each contract will be increased by $750,000, from $2,550,000 to $3,300,000 and extend the contract term by one year.  Approval of these assignments and amendments will ensure a seamless transition of responsibilities from LUS and will provide adequate authorization to spend to enable SBCFPD to effectively initiate and carry out all duties assigned as of the effective date. Sufficient appropriation is included in SBCFPD’s Fire Administration-Fire Hazard Abatement (1062022410) 2026-27 Budget and will be included in the 2027-28 recommended budget.

 

BACKGROUND INFORMATION

The County, through LUS, currently administers contracts for on-call fire hazard abatement services.  These services include inspecting properties for hazardous vegetation conditions, enforcing abatement requirements, and coordinating abatement work when necessary. The program supports public safety by reducing fire risk and helping ensure compliance with applicable local and state requirements.

 

The fire hazard abatement process includes the proactive inspection of properties to determine if hazardous fire conditions exist. Mountain region parcels are inspected once per year during the summer season. Desert and Valley regions are inspected twice per year during spring and fall seasons.

 

When hazardous conditions are identified, the owner is notified and given 30 days to abate the hazard. After 30 days, the property is re-inspected, and if the property is not in compliance at that time, LUS brings the property into compliance by abating the hazard. These abatement services are performed by contractors, and the property owner is billed for labor and administrative costs related to the services performed. The impact of these efforts is two-fold: it provides defensible space around properties and structures, and increases safety for the community members, firefighters, and other first-responders.

 

On August 9, 2022 (Item No. 22), the San Bernardino County Board of Supervisors (Board) approved the following on-call fire hazard abatement services contracts, with an aggregate total not-to-exceed $1,050,000, for the period of September 1, 2022, through August 31, 2025:

 

                     Contract No. 22-744 with Alex Bohanek dba A.B. Landscape;

                     Contract No. 22-745 with Sustainable Mitigation; and

                     Contract No. 22-746 with C & M Weed Abatement.

 

On December 5, 2023 (Item No. 35), the Board approved the addition of Contract No. 23-1294 with AD Improvements, Inc., for similar services, total aggregate not-to-exceed amount of $1,050,000, for the period of December 12, 2023, through August 31, 2025.

 

These contracts were subsequently amended as follows:

 

                     January 23, 2024 (Item No. 38): The Board approved Amendment No. 1, increasing the aggregate not-to-exceed amount by $1,500,000, from $1,050,000 to $2,550,000, with no change to the contract terms.

                     May 6, 2025 (Item No. 19): The Board approved Amendment No. 2, extending the contracts for one additional year, resulting in a total contract period of September 1, 2022, through August 31, 2026.

 

A related item on today’s Board agenda, titled “Agreement for Fire Hazard Abatement Services,” seeks approval of an agreement between San Bernardino County, through LUS, and SBCFPD to transition administration of the Fire Hazard Abatement Program to the San Bernardino County Fire Protection District, effective July 1, 2026.

 

Approval of this item will support that transition by assigning and novating the existing on-call fire hazard abatement services contracts to the SBCFPD, increasing the aggregate not-to-exceed amount by $750,000, from $2,550,000 to $3,300,000, and extending the term by one year, through August 31, 2027.
