Recommendation

Approve Amendment No. 1 to Agreement No. 23-528 with the Baker Community Services District, for the operation of the Baker Medium Volume Transfer Processing Facility, and transportation of municipal solid waste collected to the Barstow Sanitary Landfill in the event that the County is unable to provide service, increasing the not-to-exceed amount by $383,064, from $348,254 to $731,318, and extending the term by three years, for a total term of July 1, 2023 to June 30, 2029, with an option to extend for one additional three-year period.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works - Solid Waste Management Division (SWMD) is funded by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. Funding in the not to exceed amount of $127,688.01, and ongoing annual costs thereafter, will be included in SWMD’s 2026-27 recommended budget and in future recommended budgets.

The annual cost of up to $60,701.21 per year to haul municipal solid waste to the Barstow Sanitary Landfill is only in the event that the County is unable to perform this function. Historically, over the last 29 years since the Baker Community Services District (BCSD) has been operating the Baker Medium Volume Transfer Processing Facility (BMVTPF), the BCSD has not used this service. The total agreement cost is approximately $383,064 over the three-year term.

 

BACKGROUND INFORMATION

Amendment No. 1 will allow the BCSD to continue the operation of the BMVTPF on property owned by the BCSD, as well as allow for the transportation of municipal solid waste to the Barstow Sanitary Landfill if the County is unable to transport the waste (e.g., due to equipment breakdown).

 

The BCSD has been operating a community collection center on its property since June 1997, when the County’s then landfill operation contractor entered into an agreement with BCSD to construct and operate the collection center. From June 2001 to present, the County has contracted with the BCSD to continue to operate the community collection center.

 

On June 13, 2023 (Item No. 62), the Board of Supervisors approved the current Agreement No. 23-528 (Agreement) in the amount not to exceed $348,254 for a three-year term from July 1, 2023 to June 30, 2026, with the option to extend the term for an additional three-years.

 

Amendment No. 1 will allow BCSD to continue to operate the BMVTPF for an additional three years, from July 1, 2026 to June 30, 2029, with the option to extend up to one additional three-year period.
