RECOMMENDATION(S)

Recommendation

Approve amendments to the revenue generating Waste Disposal Agreements for 15 cities and towns listed below, to adjust the Waste Disposal Contract Rate to be equal to 83% of the County’s posted gate rate, eliminate the annual rate adjustment calculations and extend the term nine years, effective July 1, 2026:

1.                     City of Adelanto, Amendment No. 6 to Waste Disposal Agreement No. 04-321, for a total contract term of April 27, 2004 to June 30, 2035.

2.                     Town of Apple Valley, Amendment No. 9 to Waste Disposal Agreement No. 98-48, for a total contract term of January 27, 1998 to June 30, 2035.

3.                     City of Barstow, Amendment No. 9 to Waste Disposal Agreement No. 98-590, for a total contract term of July 7, 1998 to June 30, 2035.

4.                     City of Big Bear Lake, Amendment No. 10 to Waste Disposal Agreement No. 98-744, for a total contract term of August 25, 1998 to June 30, 2035.

5.                     City of Colton, Amendment No. 9 to Waste Disposal Agreement No. 98-302, for a total contract term of May 12, 1998 to June 30, 2035.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works - Solid Waste Management Division (SWMD) is funded by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. The proposed amendment would adjust the Waste Disposal Agreement (WDA) rate to be equal to 83% of the current approved general public gate rate. Currently, the general public gate rate, without the Comprehensive Disposal Site Diversion Program (CDSDP) recycling fee of $12.00, is $49.49 per ton. Thus, the WDA rate for 2026-27 will be $41.08, a reduction of $0.99 from the current WDA rate of $42.07. The revenue reduction for 2026-27 is anticipated to be approximately $631,000. The anticipated revenue has been included in SWMD’s 2026-27 budget and estimated future revenue will be reflected in future recommended budgets. 

 

BACKGROUND INFORMATION

The proposed amendments to the WDAs (Amendments) will adjust the WDA Contract Rate to be equal to 83% of the County’s approved general public gate rate (minus the CDSDP fee), eliminate the annual adjustment calculations, extend the term of the WDAs nine years, from July 1, 2026 to June 30, 2035, while guaranteeing that all of the cities’ waste is delivered to the County’s Disposal System.

 

The WDAs were originally 15-year agreements with 16 cities and towns within the County that obligated the cities and towns to deliver their controllable waste to the County’s Disposal System in exchange for a reduced contract rate for disposal at a designated disposal facility for each city and town.

 

On December 16, 1997 (Item Nos. 48, 50a, 50b), the Board of Supervisors (Board) approved the first WDAs with the cities of Rialto (Agreement No. 97-1043), San Bernardino (Agreement No. 97-1051), and Victorville (Agreement No. 97-1052). Over the following years, a total of 16 cities and towns entered into WDAs, with Adelanto being the last city to sign in 2004. In December 2012, the City of San Bernardino’s WDA expired and their City Council took action not to extend its WDA.

 

On December 18, 2012 (Item No. 62), the Board approved extending the end date of 14 WDAs, listed below, to June 30, 2016, under the same terms and conditions. The City of Adelanto’s WDA expired on April 26, 2019 and did not require an extension at the time.

On June 28, 2022 (Item No. 68), the Board approved capping the WDA Contract Rate so that it could not exceed 85% of the County’s approved general public gate rate.

 

In anticipation of the upcoming expiration of the WDAs, SWMD began working with the WDA Ad Hoc Group that was formed in June 2025 to negotiate an acceptable extension to ensure the continued waste stream from the WDA city and towns to the County’s Disposal System. The result of the process is the proposed extension of the WDAs to June 30, 2035 and adjusting the WDA Contract Rate to 83% of the County’s published gate rate that is being presented for the Board’s consideration. All of the cities, except Fontana, have approved the WDA agreement. The WDA agreement is scheduled to be considered by the City of Fontana at its City Council meeting on June 23, 2026.

 

The recommended action supports the goals and objectives of the County and Chief Executive Officer by operating in a fiscally-responsible and business-like manner and fostering sustainable development through strategic partnerships by ensuring the continued waste stream from the WDA cities/towns to the County’s Waste Disposal System.
